2、法治进步，而且这也是历史发展的必然。尽管社区矫正制度我国取得了一些成果，但仍然不成熟，存在着很多问题，而社区矫正手段尤为如此。我国社区矫正主要手段有参加社会公益劳动、开展引导式教育、进行技能培训帮助就业、采取报告制或走访制；而国外先进的社区矫正经验可以供我国借鉴。美国的主要矫正手段有日报告中心、家庭拘禁，社会公益劳动，间歇拘禁；日本的主要矫正手段有个别处遇、集体处遇、中途之家。通过国内外的社区矫正手段的比较，我国的社区矫正手段在社会公益劳动、思想教育、管理方式、监管能力四个方面存在不足，并且针对这四个方面的不足提出了明确
