5、sofEuropeinthefieldofpatentscontributessignificantlytotheintegrationprocessinEurope,inparticulartotheestablishmentofaninternalmarketwithintheEuropeanEconomicAreacharacterizedbythefreemovementofgoodsandservicesandthecreationofasystemensuringthatcompetition

6、intheinternalmarketisnotdistorted,CONSIDERINGthatthefragmentedmarketforpatentsandthesignificantvariationsbetweennationalcourtsystemsaredetrimentalforinnovation,inparticularforsmallandmediumsizedenterpriseswhichhavedifficultiestoenforcetheirpatentsandtodef

7、endthemselvesagainstunfoundedclaims,WISHINGtoimprovetheenforcementofpatentsandtoenhancelegalcertaintybysettingupaEuropeanandCommunityPatentsCourtforlitigationrelatedtotheinfringementandvalidityofpatents,CONSIDERINGthattheintegratedandexclusiveEuropeanandC
