3、smsuchasconceptualanaly-sisandthereforemightbecommittedtodescriptivism.ThepapershowsthattheresponsesofPerryandColemantothemethodologicalproblemarenotfreefromdifficulties.Thearticlealsoadvancesareinterpretationofnormativismintermsoftwotenets:1.thesemanticstingargument,and2.theam
4、etaphysicalthesisargument.Ifthelatterargumentissound,normativismisunavoidable,becauseiftherecannotbeanexternalpointofvieworArchimedeanperspective,thenwecanonlyresorttoourmoralconvictionsorsubstantiveclaims.Thefirsttenethasbeencriticizedinpre-viousworkandthepaperfocusesonacritic
5、ismofthesecondtenet.1.Introduction:ThePhenomenologyofLegalPracticeandtheMethodologicalControversyLegalphilosophy,likeotherbranchesofphilosophy,isnotfreefrommethodologicaldifficultiesandcontroversies.Theaimoflegalphilosophy,atfirstglance,istoexplainthecorefeaturesoflegalphenomeno
6、logy.Themethodologicaldebateinjurisprudencehasfocusedontwodifferentapproaches.First,descriptivejurisprudencearguesthatwecanprovideadescriptionoflaw.Withinthisconception,twoperspectivescanbeidenti-fied.AnumberoflegalphilosopherssuchasMichaelMoore(1987,1988,1991,1992a,1992b,19941
