1、中文摘要中国革命根据地法制建设虽然只有短短二十几年的历史，但其法制建设成效卓著，为社会主义法律体系的形成积累了历史经验，提供了理论依据，基本上孕育了新中国的法律体系，具有重要的理论价值和研究意义。中国革命根据地法制的发展历程，大致经历了第二次国内革命战争时期中央苏区工农民主政权的法制建设、抗日战争时期陕甘宁边区抗日民主政权的法制建设、解放战争时期东北解放区(包括哈尔滨解放区)和华北解放区的法制建设这几个最为重要的阶段或环节。这些根据地的法制建设特色鲜明，对新中国的法制建设影响十分深远。同时，通过比较，笔者发现，虽然在不同的时期和阶段，革命的形势、任务、目标各异

2、，但从总体上来说却是一脉相承的。也就是说，都是在传承前一阶段的法制建设成果和经验的基础上发展变化的。因此，通过仔细研究革命根据地法制建设不同阶段的立法思想特点、立法内容特点及司法建设特点，就可以略窥革命根据地法制建设发展的基本脉络，探究革命根据地法制建设精神的传承和发展变化的规律，并进而总结革命根据地法制建设的经验和教训，为我国正在进行的建设社会主义法治国家的伟大实践指明方向，并提供历史借鉴。同时，从总体趋势上来看，革命根据地法制建设发展的重心基本上与中国革命发展的道路相吻合，即“从农村到城市”。正是解放战争时期哈尔滨解放区民主政权建立以后，中国革命根据地法制
