1、内容摘要改革开放以来，我国一方面在经济建设上取得了巨大成就，但另一方面，建筑类文化遗产也遭NT严重的破坏，尤其是在当前的城市化进程中，建筑类文化遗产的保护问题，更是面临着严峻的挑战。但我国目前的建筑类文化遗产法律保护制度还不完善，有关的理论研究也尚欠深入，因此对建筑类文化遗产的法律保护问题进行全面的分析和研究，非常必要。人类的生存环境包括自然环境与人为环境，建筑类文化遗产属于人为环境的范畴，是环境的构成要素之一，但目前环境法对于人为环境还没有做出明确的晃定。因此本文首先从环境法对人为环境的界定作为问题的切入点，分析当前环境法对人为环境难以界定的原因，并试用调整论

2、和生态学的观点，探讨环境法界定人为环境的可能性，明确必须在法律上赋予人为环境以生态环境地位，才能对人为环境要素实旌有效的环境法保护。然后将建筑类文化遗产放到人为环境中进行考察，回归其生态环境的本质，分析其所具有的包括生态价值在内的价值属性。最后回到建筑类文化遗产的法律保护问题上来，先介绍国际保护的经验，以及由此给我们带来的启示，再评述我国的建筑类文化遗产保护制度，并对制度的迸一步完善提出了自己的几点思考。关键词：建筑类文化遗产人为环境法律保护AbstractAsthereformandopeningtotheoutsideworld,Chinahasontheo
