2、ustomary(adat)lawandtoMoslemreligiouslaw.”Thekeypurposesofthereformofmarriagelawswere“thedevelopmentofcodificationanduniformityinIndonesia'slegalsystemandtheimprovementofwomen'sposition.”A.WordingandInterpretationArticle2(1)ofthe1974MarriageLawprovidesthat“amarriageislegitimate,ifithasbeenp

3、erformedaccordingtothelawsoftherespectivereligionsandbeliefsofthepartiesconcerned.”Thisisemphasizedintheimplementingregulations,whichrequirethat“themarriageceremonyshallbeperformedaccordingtothelawsoftherespectivereligionandfaith.”The1974MarriageLawalsorequiresthateverymarriagemustbe“regist

4、eredaccordingtotheregulationsofthelegislationinforce.”Theimplementingregulationsstatethatnon-MuslimmarriagesmustberegisteredwiththeCivilRegistryOfficefollowingthereligiousceremony,whileMuslimmarriagesmustberegisteredwiththelocalOfficeofReligiousAffairs.Theseprovisionshavebeeninterpretedaspr

5、ohibitingmarriagebetweenpeopleofdifferentreligions.Thisisbecause,inorderforamarriagetoberegistered,amarriageceremonymustbeconductedinaccordancewitharecognizedreligion,andinmostcasesatleastoneofthepartieswilladheretoareligionthatdoesnotallowapersontomarrysomeoneofadifferentfaith.However,asth

6、e1974MarriageLawdoesnotexplicitlyforbidorallowmarriagebetweenpeopleofdifferentreligions,thereisconsiderabledebateregardingitsinterpretationandapplication.Forexample,analternativeinterpretationtoanabsoluteprohibitionisthatArticle2(1)onlystatesthatmarriagemustbeconductedaccordingtoreligiousla
