1、摘要■■■●■—■———■■—■——■■——■——■————嘲囊麓■酋■一II——●——■●—■-侦查阶段是刑事诉讼中一个十分重要的阶段，也是社会上引起争议较多的阶段。侦查阶段侦查权的行使大都与公民的各种权益有关，如果缺乏必要的程序监督和保障，侦查权就可能被滥用而侵犯公民的权利。面对我国侦查监督中存在的诸多问题，如何规范与控制侦查权，从而建立更合理科学的侦查程序，成为当前法学界广泛探讨的热点。本文试从比较法的视野，通过对英美法系英美两国和大陆法系德法两国侦盔监督机制的分析，主张在我国司法理论及实践中吸收和借鉴两大法系对侦查程序的

2、司法审查。并在此基础上对我国侦查监督的现状从对刑事诉讼目的把握的失衡和侦查程序的行政化两个方面进行了反思。同时通过以上分析借鉴和反思，本文从完善我国侦查程序中的控辩平等，确立侦查程序的诉讼构造和建立程序性制裁机制三个方面对我国的侦查监督机制进行了重构，以期寻找完善我国侦查监督机制的路径，规制我国侦查权的行使，达到惩罚犯罪和保障人权的和谐统一。关键词侦查模式侦查监督诉讼构造诉讼目的控辩平等Abstract_-_●___■_____IIIIIIIIIIIIIIIIIIiI]iIII_Investigatestageisaveryim
