1、AGREEMENTONIMPLEMENTATIONOFARTICLEVIOFTHEGENERALAGREEMENTONTARIFFSANDTRADE1994  Members hereby agree asfollows:  PARTI Article 1 Principles             AnantidumpingmeasureshallbeappliedonlyunderthecircumstancesprovidedforinArticle VIof GATT 1994 andpursuanttoinvestiga

2、tionsinitiated[1] andconductedinaccordancewiththeprovisionsofthisAgreement.  ThefollowingprovisionsgoverntheapplicationofArticle VIofGATT 1994insofarasactionistakenunderantidumpinglegislationorregulations.  Article 2 DeterminationofDumping 2.1       Forthepurposeofthis

3、Agreement,aproductistobeconsideredasbeingdumped,i.e.  introducedintothecommerceofanothercountryatlessthanitsnormalvalue,iftheexportpriceoftheproductexportedfromonecountrytoanotherislessthanthecomparableprice,intheordinarycourseoftrade,forthelikeproductwhendestinedforcon

4、sumptionintheexportingcountry. 2.2       Whentherearenosalesofthelikeproductintheordinarycourseoftradeinthedomesticmarketoftheexportingcountryorwhen,becauseoftheparticularmarketsituationorthelowvolumeofthesalesinthedomesticmarketoftheexportingcountry[2],suchsalesdonotpe

5、rmitapropercomparison,themarginofdumpingshallbedeterminedbycomparisonwithacomparablepriceofthelikeproductwhenexportedtoanappropriatethirdcountry,providedthatthispriceisrepresentative,orwiththecostofproductioninthecountryoforiginplusareasonableamountforadministrative,sel

6、lingandgeneralcostsandforprofits.               2.2.1                Salesofthelikeproductinthedomesticmarketoftheexportingcountryorsalestoathirdcountryatpricesbelowperunit(fixedandvariable)costsofproductionplus administrative,sellingandgeneralcostsmaybetreatedasnotbein

7、gintheordinarycourseoftradebyreasonofpriceandmaybedisregardedindeterminingnormalvalueonlyiftheauthorities[3] determinethatsuchsalesaremadewithinanextendedperiodoftime[4] insubstantialquantities[5] andareatpriceswhichdonotprovidefortherecoveryofallcostswithinareasonablep
