3、ordingtothesaidprovisions;iftherelevantlawsandadministrativeregulationsdonotcontainpenalprovisions,thebankinginstitutionshallbepunishedaccordingtotheseMeasures.Theterm“bankinginstitution”intheseMeasuresmeansthefinancialinstitutionsthatarelegallyestablishedandengagedinbankingbusines

5、fChina;however,theadministrativesanctionsstipulatedinArticle24andArticle25oftheseMeasuresshallbedecidedbytheforeignexchangecontroldepartmentoftheState.DisciplinarysanctionsstipulatedintheseMeasures,includingwarning,recordingofademerit,recordingofamajordemerit,demotion,removalfrompo
6、st,placementonprobationanddismissal,shallbedecidedbytheemployingbankinginstitutionorthebankinginstitutionatahigherlevel.AnyemployeeofabankinginstitutionwhohasbeensubjectedtothedisciplinarysanctionofdismissalaccordingtotheseMeasuresshallnotworkinanybankinginstitutionagain,andthePeop
