1、LANDACQUISITIONRULES1998PU(A)70/1998INexerciseofthepowersconferredbysection69oftheLandAcquisitionAct1960,theMinister,withtheapprovaloftheNationalLandCouncil,makesthefollowingrules:1.Citationandcommencement.TheserulesmaybecitedastheLandAcquisitionRules1998andshallcomeintoforceon1Marc

2、h1998.2.  Referencetoform.AreferenceintheseRulestoaformidentifiedbyanArabicnumeralisareferencetoaformidentifiedbythatnumeralintheFirstSchedule.3.Application.Anapplicationforacquisitionofanylandunderparagraph3(1)(b)or(c)oftheActshallbemadeinForm1.4.Fee.Thefeepayableforanapplicationfo

3、racquisitionofanylandunderparagraph3(1)(b)or(c)oftheActshallbeasprescribedintheSecondSchedule5.Deposit.(1)Thedepositpayableforanapplicationforacquisitionofanylandunderparagraph3(1)(b)or(c)oftheActshallbeatarateofonehundredandtwenty-fivepercentumoftheestimatedmarketvalueofthelandtobe

4、acquired,asdeterminedbyavaluationofficeremployedbytheGovernment,andshallbepayable,intheformofabankdraft,inthefollowingmanner:(a)fiftypercentumofthedepositshallbesubmittedwiththeapplication;(b)theremainingseventy-fivepercentumshallbesubmitteduponacceptanceofthetermsandconditionsofthe

5、approvalimposedbytheStateAuthority.(2)Wherethecompensationawardedundersection14oftheAct,ortheamountclaimedbythepersoninterestedmadebeforetheLandAdministratorundersection12oftheAct,ishigherthanthedepositrequiredundersubrule(1),theLandAdministratorshallinForm2requireanadditionaldeposi

6、tamountingtotheamountofcompensationawardedbytheLandAdministratorortheamountofclaimbythepersoninterested,whicheveristhehigher,tobepaidwithinthirtydaysoftherequirement.6.Noticeofnegotiation.WheretheStateEconomicPlanningUnit,ortheCommitteefortheFederalTerritoryofKualaLumpur,asthecasema

7、ybe,issatisfiedthatitisappropriatefortheregisteredproprietortoparticipateintheprojectforwhichthelandisintendedtobeacquiredundersubsection3A(3)oftheAct,itshallgiveawrittennoticetotheapplicantinForm3withinsixweeksfromthedateofreceiptoftheapplicationfromtheLandAdministratorundersubsect
