1、论法律方法的异化及其危害内容提要：司法过程中的法律方法是在司法实践基础上所作的理论总结，而不是单纯地依据法学理论进行的逻辑归纳。笔者对目前法学理论界持有的法律方法必然具有正当属性的观点表示质疑，提出司法实践中法律方法的异化问题，并剖析其异化的基本形态及危害。同时，从社会信息经济学的视角论证法律方法的异化现象与司法资源交易行为的辩证关系，指出二者的相互依存、相互转化、相互促进必然会导致司法资源的市场化配置和运作，形成司法方法的制度性腐败。关键词：法律方法法律方法的异化司法资源的交易司法资源的市场化配置论法律方法的异化及其危害——兼析司法过程中司法资源的市场化配置organizatinsy
