3、heformofillegaltaxavoidancelegalbutactuallyillegal,itviolatedtaxpurposes,doesnotconformtothefairprincipleofTaxation,substantialjusticeoftaxloss,thusshouldbedefinedasillegalandlegalregulations.Taketheviewthatthetaxevasionisneitherlawfulnorillegal,butabehaviorthatisincons
4、istentwiththepurposeofthelaw,butcannotbeappliedinlaw.Itsessenceistomakeuseoftheloopholesinthelawtoachievecertainbehavioralgoals,andatthesametimeachievethegoalthatthelawcannotbeappliedtoit.Thefirstviewbecausethenecessityofseriousobstacleavoidancebehaviorintensifiedandthe
5、functionoftherealizationofthetaxandtaxavoidanceregulationandhasbeenrejectedbymostscholars,andthentwokindsofviewsshouldbenowadaysthemainstreamviewofTaxLaw--fortaxavoidancebehaviorisillegal(includingillegalandtheremovalmethod).Two,defineandanalyzetheconceptoftaxavoidanceB
6、eforewemakeaconcreteanalysisoftaxavoidance,wemusthaveacleardefinitionoftheconceptoftaxavoidance,whichisthepremiseofallanalysisanddiscussion.Althoughmanycountrieshaveyettotax,taxevasionandtaxavoidancehaveclearlydefined,butIalreadyhadanagreementAncientChineseLiteratureSea
