4、esforeffectivestewardshipofwater.IntheWest,farmershistoricallyhaveusedroughly80percentoftheregion’swater,ofteninlow-valuedorsubsidizedcrops,suchasalfalfa,cotton,orrice.Farmerstypicallypayonlyforthepumpingorconveyancecostsforthewaterandnotforitsscarcityvalue.

6、erringthiswater.Thepublictrustdoctrineraisesthequestionofwhetherornotwatertransferswilloccurthroughmarkettransactionsorthroughthepolicepowerofthestate.Markettransactionsrelyonandreaffirm(throughprecedent)securepropertyrightstowater.Statere-allocationthrought
7、hepublictrustdoctrinereliesinsteadonjudicialandagencyactionsandcanweakenpropertyrightsandtheirabilitytosupportwaterexchangeandtoencourageprivateinvestmentinwaterquality,riparianandaquatichabitat,andotherinfrastructure.Becauseitemphasizesthe“publicness”ofwate
