3I.大学组织A.历史耶鲁大学的前身是1701年由10名教会牧师在康涅狄格州的赛布鲁克创建的学院式学校。1716年,该校迁址至纽黑文。1813年创建了医学院,1822年神学系成立,后发展为神学院。1824年,有三名耶鲁研毕业生在纽黑文创建的私立法学院成为了耶鲁学院的附属学院,并且,耶鲁从1843年开始授予法学学士学位。之后,谢菲尔德科学学院和研究生院相继建立。美国的第一个博士学位于1861年在耶鲁学院被授予。在1887年,该学校的名称被法定为耶鲁大学。此后,音乐学院、林业及环境研究学院、护理学院、工程学院、戏剧学院、艺术学院、建筑学院和管理等分别成立。1945年,谢菲尔德科学学院的活动及工作均假定由耶鲁学院和研究生院开展。学校的工程学院和部分自1861年起在谢菲尔德科学学院成立的部分专业,于1932年成立了独立学院。1962年,它的大部分学术任务被转移到工程及应用科学系,该系此后又被分成了几个系,被称为工学部并由工程学院院长领导。自1892年和1969年起,研究生院和耶鲁学院分别开始正常招收女性学生。B,耶鲁大学董事会耶鲁宪章规定,关于“领导、关心和管理”耶鲁大学的终极权カ归耶鲁董事会所有。耶鲁董事会共有19人组成,包括:耶鲁大学校长,负责主持所有会议;康涅狄格州州长和副州长,为当然成员;10名原董事继承人,可连任两届,每届任期为六年;6名校友会院士,由毕业生选举产生,每年选举一人,每人每届任期为6年。在特殊情况下,经校长推荐,原董事继承人可以经选举延长任期,但额外延长期最多不得超过3年。董事会会议在每学年定期举行。C.大学官员耶鲁大学的官员由耶鲁大学校董会任命。包括校长、教务长、副校长兼大学秘书、主管财务及行政事务的副校长、主管发展的副校长、副校长兼总法律顾问、副校长兼纽黑文和州事务办公室主任,以及其它由校董会委任的官员.关于各官员的权カ及职责的描述请参见《耶鲁董事会章程》。
4D.大学的学院和教授会耶鲁大学的学位和学习课程由以下标明了创建日期的12所学院提供:耶鲁学院(1701),耶鲁医学院(1813),神学院(1822),法学院(1824),艺术学院(1865),文理研究生院(1892),音乐学院(1894),森林与环境研究学院(1900),护理学院(1923),戏剧学院(1955),建筑学院(1972)和管理学院(1974)。每个学院都有各自的院长,教授会,和永久性官员委员会或其它领导团体,均需经耶鲁董事会批准。耶鲁学院和研究生院的全体教师构成了文理科教授会。文理科教授会受文理科教授会执行委员会领导,由校长、教务长、耶鲁学院院长、耶鲁研究生院院长组成。在校董会的终极权カ之下,经校长或教务长推荐,每个学院的教授会可通过此类委员会并采用各自程序决定本学院的教育政策。在文理教授会,在决定聘任问题时,所有全职教授都应出席会议,共同决定,该会议也被称为耶鲁学院和研究生院永久性官员委员会联席会议。在各专业学院,所有获永久聘任的全职教授,以及各当然成员,包括学院院长,校长和教务长,组成了永久性官员委员会,除非该学院的聘任结构要求由其它的领导团体负责,并已通过校董会的批准。n.基于言论自由的大学政策1975年,耶鲁大学言论自由委员会1主席C.VannWoodward曾写到:一所大学的主要功能就是通过研究和教学等途径来发现知识和传播知识。为实现这ー功能,观点和思想的自由交流是必须的,不仅仅是在围墙之内,同外部世界的交流也是必须的。因此,一所大学必须尽其所能确保其内部拥有充分的智カ自由。智力发现和发展的历史清楚地表明了对无拘束的自由的需要,想象不可思议的事情,讨论不宜言传的事情,挑战不可挑战的事物的权カ,对言论自由的剥夺将对智力自由造成两次打击,因为在剥夺别人发表ー些不受欢迎的观点的权《言论自由委员会报告》(耶鲁大学,1975年1月)カ的同时,也必然剥夺了他人听取这些观点的权カ。这所大学的成员已经自由地将他们自己同耶鲁联系在了一起,并通过这种做法已经确定了他们对于相互容忍和相互尊重这一哲学的遵守。对这ー共同体内任何成员进行身体上的限制、压迫和恐吓都是有违这所大学的基本政策的。妨碍学校大学的正常功能和活动,如讲座、会议、接见、庆祝或其它公共活动,也违反了这些基本原则和大学规章。在耶鲁校园内或耶鲁的教学楼或其它设施内阻止他人的合法活动也同样是对这些基本原则的违反。
5III,教师级别、聘任和政策:全校范围A,机会均等和肯定行动大学在评判是否录取、教育及雇用某ー个人时,仅对当事人的资格和能力进行评判,并欢迎具有不同背景的符合条件的教职员エ和学生。根据这项政策,并依照联邦及康涅狄格州法律,耶鲁大学在招生,实施教育计划,或人事聘用过程中不会因个人的性别,种族,肤色,宗教,年龄,残障,或因特别伤残退伍军人的身份或越战退伍军人身份而对个人有所歧视,学校也不会歧视个人的性取向。学校政策在录用妇女、少数民族成员、残障人员、特别伤残军人、越战退伍军人时,遵照法律规定遵守“肯定行动”规定。有关该项政策可咨询学校机会均等项目办公室。学校有书面的有关录用妇女、少数民族成员、残障人员、特别伤残军人、越战退伍军人及其它退伍军人的肯定行动计划,可到机会均等项目办公室查看该计划的副本。B,教师级别耶鲁大学对梯级教师系列、非梯级教员系列(如助手和访问学者)以及研究人员系列有不同的规定。之间的区别包括聘任和评审程序、请假和福利政策、在某ー级别的最大年限等。在全校范围内,梯级系列包括:初级,包括讲师和助理教授;高级,包括合同制副教授、终身制副教授和教授。(有关教师级别的详细描述请参见IV-VI部分)C.关于教师聘任过程中招聘和评审程序的肯定行动学校将通过公布教师职位并在聘任前征求候选人意见的方式确保聘用到最有可能的具备资格的教师,并使聘任程序符合大学关于公开招聘和肯定行动的目标.通常情况下,招聘包括大范围发布广告,例如在学术期刊、时事通讯或学术会议上发布公告,还包括通过信件,电子邮件或电话的方式主动联系相关的代表认为或学校和院系等。当一般的公告方式不奏效时,各院系应采取努力措施,以反应出该职位的特殊点以及相关的候选人范围。总的来说,对于教授、副教授和助理教授,包括各级别助手的聘任,都要求具有说明整个遴选过程的书面材料。在实施该遴选方案前,该方案必须通过机会均等项目办公室的审查,并由教务长授权的代表同意。各专业学院(professionalschools)还需指定数名肯定行动代表,以协助遴选委员会录用妇女和少数民族成员。有关聘任程序的详情请查看由教务长和个专业学院院长制定并印发的备忘录。
6D.聘任机构耶鲁大学对所有教师职位的聘任都必须由由校长提名,或提名经校长或教务长通过,经耶鲁董事会投票决定。对于终身聘任的决定须先由永久性官员委员会向教务长的推荐,或由授权的某一学院的相关管理委员会提出。其它聘任可由永久性官员委员会或其它管理机构推荐,或由院长或其它合适的聘任委员会基于学院的聘任提出推荐意见。终身聘任或晋升终身聘任的决定只能在教务长批准该终身聘任职位的授权后做出。非终身制的耶鲁教员只有在某ー职位在相关领域获得认可之后才能有资格成为耶鲁终身职位的候选人。因此,在终身职位空缺(虽然这些职位可以是新增的或新指定的,一般情况下是由于退休或辞职而产生的空缺)被填补之前,必须经过校务长批准。职位的分配一般由相关的咨询/顾问机构向教务长提供建议。只有经耶鲁董事会通过校长或教务长的推荐后才能产生最终的聘任决定。除非经校董会批准,耶鲁大学的任何教员都无权授权学校进行任何学术聘任。但是,经教务长批准后,各系主任或学院院长,或他们的委托人,可以讨论有关聘任相关候选人的聘任期限等问题。关于校董会做出的有关聘任决定的投票结果的通知由学校秘书办公室负责送交给相关受聘人员。E.职位和雇用期限凡在耶鲁大学获得梯级教师职位的教师不得同时担任其它学校的终身制岗位。但仍可接收其它单位的聘任,只要这些职位是公开的,且不与耶鲁大学的利益或向耶鲁大学承诺的义务冲突。(参见X.D.部分)所有全职受聘于耶鲁大学的教师在一学术年度内,不得在其它单位兼职教学岗位,即使以访问身份也不可以,除非经过教务长的特殊批准,并且在此种情况下,该教师将不得再享受学校的额外津贴。除终身岗位的聘任以及在ー些专业学院内进行的连续的教授级别的聘任,对某一特定级别的教师岗位进行的有具体期限的聘任,聘任期限可从一学期到五年不等。虽然一般情况下非梯级教师级别的聘任时间是有限制的,但是许多期限聘任都是可以续聘的/可更新的。大部分的此类聘任都是以全职聘任的工资补偿级别予以进行的,也就是说属于全职聘任,或是以9个月为期的学术年度的标准,或是以一整日历年为标准。但此类聘任的工资水平与其它的终身制聘任2不同,是有可能比全职聘任要低的,且每年可以不ー样。因此,区别聘任的级别和期限关系,以及理解有关聘任的片段和延续是十分重要的。
7F.非终身制梯级系列的最大时间限度除特定的执教于医学或护理专业的教师外,耶鲁大学所有以助理教授或副教授级别聘用的教师,其在该级别的聘用时间总共最长不得超过10年,也不得超过以下描述的延长后的时间。这10年的最长期限可以再延长三年,如果某教师在聘任期间:(a)请假参加公益事业(b)请产假或看护假(Caregiver,sLeave)时间超过六周的,或(c)由于分娩或短期的因疾病无法工作超过六周而给予延长的假期(参见VILD部分)终生制聘任エ资比全职聘任低的情况只在极特殊的情况下发生,且只在有限的一段时期内发生。由以上原因在非终身制梯级级别产生的延长期限的总和不得超过3年。对于期间在耶鲁大学以兼职梯级教师形式聘任的教师,按照比例,在最长为3年的限度内,也可以予以延长。(例如,教师以兼职形式授课两个学术年度的,可以在最大10年期限的基础上延长1年。)在医学院和护理学院,10年的最长期限包括在耶鲁大学以梯级教师级别聘任的时间和所有(最长为3年)的在其它单位进行全职教学的时间。这两种情况不包括该教师在没有持博士学位进行教学的时间,或与其等值的学术年度的任何时间。G.聘任终止与不再续聘的通知按合同期限聘任的教师的续聘在耶鲁不是自动进行的。在做出是否续聘或晋升某一教师的决定之前,各学院和各系要对候选人的工作和承诺做出仔细的评估,并考虑本学院或本系的课程需要。对全职期限聘任教师做出的不再续聘的通知需以书面形式按照如下时间表给出,但是如果该通知没有及时给出,并不表示给予延长聘任期或续聘。对于聘任合同期限在三年或以上的全职梯级系列教师,一般情况下,不再续聘的通知应在聘任合同到期前一年给出。在特殊情况下,以助理教授受聘于梯级教师系列的、合同期限至少在3年以上的教师,可以以书面形式申请将评估推迟到合同到期前的秋季学期,从而撤销提前一年的通知.各学院和各系没有义务必须通过这些申请,对这些申请的通过只有在教务长办公室同相关院长协商批准后做出。在这种情况下,各系关于晋升、续聘或终止聘任的决定必须在最后学术年度的12月1日前告知相关个人。除非是在第十年或非终身制梯级系列的最后一年,否则,只有在极特殊的情况下
8才能批准延期评估/考核。对于全职聘任的教师,在其第五年或任何类似的以1或2年任期聘任的非梯级教师,不再续聘的通知一般都应在聘任合同的最后一年的10月31日前给出。具体关于文理科教师中公共讲师(lector),高级公共讲师(seniorlector),助手,和讲师的不再续聘的通知,参见IV.A.11部分。由于缺少外部薪金支持而产生的对研究型教师的终止聘任通知,参见V.A.部分。有关具体的专业学院的终止聘任的通知请参见第IV部分,并参照相关学院的聘任程序。H.不同系或学院间的联合梯级教师聘任由两个或以上不同学院或系联合聘任梯级教师岗位一般是允许的,如果受聘人可以有序地在联合聘任的学院或系通过教学,开展研究,指导毕业论文,或实施管理职责等,为本科或研究生教育做出显著贡献。联合聘任有两种。ー种是完全联合聘任,这种聘任拥有相同的聘任期限(包括终身聘任,如果聘任级别是终身制的)并且在各受聘的系或学院都拥有相应级别的投票权。此类聘任属特殊情况,须由各相关的系或学院,相关聘任委员会和管理委员会,以及校董会在首次聘任或再次聘任时投票决定。另ー种是比较普通的联合聘任,其特点是教师主要受聘于某ー系或学院,而次要(有时称“礼节性”)受聘于另一系或学院。次要聘任在时间上一般不会超过主要聘任的系或学院的聘任期。在大多数情况下,次要聘任是可以续聘的。任意ー种联合聘任新教师的计划作出后,发起学院或系应主动寻求提议的第二个学院或系共同参与候选人的遴选工作。联合聘任须由相关学院或系按照各自的聘任程序分别批准。当前受聘于文理科教授会下属的某一系的教师,在经双方各系和终身聘任委员会主席的批准后,可允许其同时受聘于另一个系,合同期限最多为5年,可续聘。受聘于某ー专业学院的教师,在得到该学院和系,以及文理科教授会终身聘任委员会的批准后,可授予其另ー个在文理科教授会的聘任职位。受聘于文理科教授会的教师,在得到相关系和学院的聘任委员会的批准后,适当情况下,还需在得到永久性官员委员会或其它授权的管理委员会的批准,可授予其在另ー个专业学院的第二职位。教师在次要受聘的系或学院的投票权カ应遵守所在系或学院的规定,除非该教师在其次要受聘的系或学院对终身聘任决定无投票权。
9在文理科教授会内部,完全联合受聘于一个系和另ー个交叉学科的系(如非裔美国人研究)或某个具体交叉学科项目(如美国人研究)的教师,在两个系均由投票资格,并且在这两个系的聘任时间是相同的。I.梯级教师级别中助理教授、副教授和教授的兼职聘任1.定义和目的允许梯级教师系列进行兼职聘任的主要原因是考虑到某些人由于个人时间压カ或专业职责无法适应学校的全职聘任。对于终身制职位(在医学院为延续性的职位)的兼职聘任的许可仅在特殊情况下做出,且仅在一定限期内。教师在兼职聘任的指定时间内,须履行教师的所有职责,包括委员会工作和管理职责。2.兼职聘任的期限和条件以兼职形式进行的梯级教师级别的聘任要求得到教务长的批准,医学院除外,医学院由院长授权。一般地,在兼职聘任一开始制定的兼职时间比例将贯穿整个聘任过程。对于时间比例的修改须得到教务长的批准(在医学院由院长批准)。兼职聘任的标准和程序与同级别的全职聘任相同。此类聘任是按照在某一学术年度内出现的全职聘任的比例(不得少于50%)进行的。由于阶段性退休的教师,聘任一般以完整的学年为单位,而不是一学期在,一学期不在。拥有助理教授、副教授或教授级别的兼职岗位的个人,在某一学术年度内,欲接受外单位聘任的,必须获得教务长或院长的批准。在医学院,临床教育系列的兼职聘任可以是全职聘任的任何比例。3.在级别内时间的延长对于拥有梯级级别兼职聘任岗位的教师,可延长其非终身制聘任的10年期限和特定级别内的时间限制,但最多不得超过3年。由教务长在得到相关院长的推荐后决定是否授予延长期。但是,在任何情况下,兼职的个人,或同时拥有兼职和全职期限聘任岗位的个人,在梯级教师级别服务的年限不得超过13年,包括在III.F部分提到的延长情况。4.休假和福利兼职聘任的个人(享受成比例的酬劳)有资格按照工作的比例享受绝大部分全职聘任教师拥有的休假。有关休假的详细信息请咨询教务长办公室。有关福利问题请咨询福利办公室。
10J.作为教师和管理人员或专业人员的双重聘任1.主要和次要聘任如果个人同时拥有一个教师岗位的聘任和一个管理或专业人员岗位的聘任,则其中有一个为主要聘任,另ー个为次要聘任,个人只有在极少数情况下才能获得完全的联合聘任,一般在签订雇用合同时或次要聘任时都会指明,但也可以由院长或教务长随时决定。如果在聘任期间,原来作为主要聘任的教师岗位变成了次要岗位,则指定的有效期从做出原教师职位不再续聘的通知前的一段时间服务期满算起,具体规定见IILG部分。如果没有做出正式的指定,则对于梯级或研究类级别中拥有双重聘任的教师,教师岗位被假定为主要聘任;对于其它级别内拥有双重聘任的教师,教师岗位被假定为次要聘任。2.终止主要聘任一旦终止,不论主要聘任为教师岗位、管理岗位还是专业岗位,双重聘任的次要岗位聘任自动终止,无预先通知,不得抱怨或再享受类似次要聘任的权利,除非《教师手册》或《人事和惯例手册》另有规定。《人事和惯例手册》可在人カ资源部网站阅览。次要聘任的终止在主要聘任终止的同时生效,除非该个人作为次要聘任正在教授当前学年的课程,则终止生效时间可以推迟到学期末。单独的次要聘任(或由于其它人事决定导致)的终止,不会自动对主要聘任造成影响。在此类情况下,个人可以延长例如通知、抱怨和《教师手册》或《人事和惯例手册》中规定的关于次要聘任的类似权利。K,教师聘任程序1.总则有关文理科教授会教师聘任的具体程序请参见在教授会中各个系主任间流通的以期刊形式印发的“遴选,聘任,请假和终止程序”。类似的材料在各专业学院所属教授会中一般在各院长间流通。复印件可从教务长或院长处获得。聘任程序一般以系或学院根据本部门的需要向教务长提出确定的拟招聘职位开始。在医学院和护理学院,只有终生制和延续性职位才需要得到教务长的特别批准。ー旦拟聘任职位获得通过,除教务长办公室,院长办公室和机会据等项目办公室等将在各阶段参与制定聘任办法外,系或学院就即可主动展开聘任工作。除医学院和护理学院外,终身制和非终身制梯级岗位一般都因退休、辞职或聘任终止而产生。如果有机会聘任到特别突出的人员来补全空缺,特别是如果能招聘到符合耶鲁大学肯定行动政策的杰出女性或少数民族成员,则聘任预算可以有弹性变化。
11a.文理科教授会的梯级岗位。当个人通过文理科教授会的一个系的遴选和投票程序被推荐为梯级岗位,则该推荐将由一个聘任委员会进行评审。如果是非终身制聘任,由期限聘任委员会进行评审,如果聘任级别为终身制副教授或教授,则由推荐的候选人所在学部的终身聘任委员会负责评审。(参见IV.A)由教务长、耶鲁学院院长、研究生院院长,以及一个成员由教务长选定特别委员会组成的委员会可以充当(或代替)学部终身聘任委员会。b.专业学院的梯级岗位。在耶鲁大学的每个专业学院,梯级教师的聘任首先由各学院级别的聘任委员会或由一个系依照院级聘任委员会的规定发起。然后由永久性官员委员会或由学院授权的管理机构对是否聘用进行投票。如果是ー些小型的教授会,则理所当然的,将由教务长指定一个常设委员会(一般被称为常设咨询及聘任委员会)或ー个特别委员会对永久性官员委员会或授权的此类教授会的管理委员会做出的终身聘任推荐提供咨询性的评审。在某些学院(如戏剧学院和音乐学院),对教授助手或副教授助手的聘任推荐意见的评审办法也按照上述办法进行。只能校董会根据校长或教务长的推荐做出的投票决定オ是聘任的最终结果。c.全校范围内的非梯级教师岗位。在文理科教授会和各专业学院都保存有向校董会推荐教师聘任的步骤做出具体规定的程序。1.关于聘任和晋升的投票当开会讨论ー个教师的聘任或晋升问题时,永久性官员委员会或其它授权的院级管理机构可以邀请与招聘职位同级别或更高级别的教师参加,并拥有投票权。但是,次要聘任与某一系或学院的教师,不论级别,都无权对晋升或终身聘任进行投票。同样,期限聘任的教师无权对是否续聘同级别的其它期限聘任的教师的问题进行投票。上述政策同样适用于文理科教授会和医学院各个系的投票办法。2.评价信的机密性对评价信保密是一项大学政策,只有在聘任程序中对某ー候选人聘任或晋升进行投票的人员オ可以看到这些评价信。评价信的内容是保密的,信件内容不得让被评价人知晓.这些信件可以在抱怨过程中被审查委员会看到,也可以出现在行政诉讼或法律事务中。3.聘任起始日和辞职的日期除非在特别情况下并得到教务长的批准,除戏剧学院和护理学院的所有学院,梯级教师的聘任起始时间为7月1日或1月1日,辞职日期为6月30日或12月31日。4.薪酬支付时间表教师聘任期为9个月,エ资按12个月发放的,每年7月和8月的工资提前支付,但是必须完成整
12个学术年度的工作才能得到薪水。(参见VIII.A.1)一年期教师的工资一般从当年9月起支付到次年5月,以学期聘任的教师的工资从9月支付到12月,或相应的从1月支付到5月。如果情况允许,并且此前得到教务长办公室的批准,以学期聘任的教师,エ资可从7月支付到12月或6月,或相应的从1月支付到6月。同样的,以一年期聘任的教师,エ资可从7月支付到6月,或从1月支付到12月。在戏剧学院和护理学院,聘任起始日期和辞职日期可从日历年的任何一天算起。研究型教师的聘任期限一般以12个月为基础,聘任的起止日期可以是一年内的任何时间。L.不续聘或不晋升的决定及其评审1。总则在决定教师聘任时,学校致カ于聘用最适合该岗位的候选人,不论该候选人当前是否与学校有关系。期限聘任的教师没有续聘或晋升的权利,也不能决定续聘,同当初的聘任决定一样,都须由学校相关机构做出专业的和学术的评价后オ能决定。决定不推荐某人续聘或晋升不一定代表对该个人学术或其它能力的否定。这可以是由于,例如,缺少相关领域的空缺,系或学院的领先地位,或有更具备此岗位资格的候选人引起的。为确保在候选人得到职位的问题上不存在误解,也为确保在系外或院外的学校利益不被忽视,并确保系或学院对于每ー个非终身聘任的教师的考虑都是充分的,文理科教授会下属各个系的系主任和各学院的院长将,理所当然的(在系或学院做出正式的聘任决定之前),同教务长办公室的一名代表和被考虑续聘讨或谨慎的教师所在的教授会的全体成员进行商讨。当不再续聘或不晋升已在耶鲁エ作一年以上的候选人的决定做出以后,系或学院在将该决定传达给候选人之前,应向教务长提交一份简短的关于做出该决定的报告。在医学院,相关系应将此报告提交给教师事务办公室。2.由教务长发起的复审程序教务长可以要求已做出不再续聘或不晋升推荐的决定的系或学院重新审议该问题。提出该要求的原因可以是多方面的,其中之一有可能为对该职位可获资源上存在误解。如果教务长对于考虑是否续聘或晋升某ー候选人问题上的充分程度拥有实质性的问题,他/她可以要求一个复审委员会(如下)来对原决定进行复审并就问题提出建议。在重新评价中也要包含系或学院的意见。
132.由教师发起的关于续聘和晋升决定的复审程序a.目的。下述复审程序适用于任一教师3,如果其认为:(1)在讨论其续聘或晋升的过程中有一项学校的政策未被遵守;(2)对其续聘或晋升的考察不充分或不公平;(3)在讨论其续聘或晋升的过程中,他/她由于种族、肤色、宗教信仰、年龄、性别、性取向、残疾,或民族或人种的原因受到了歧视。对关于学术能力的问题不是这些复审程序的目的。b.步骤非正式协商和解决.学校鼓励教师首先通过直接同相关负责人讨论的方法寻3除医学院和护理学院的志愿教师外,耶鲁大学所有的教学类教师和研究类教师均适用本程序。研究类教师(依照第V部分的规定)不得就由了其资助经费的停拨或补助金或资助合同不再延续而引起的关了续聘或晋升的决定提出复审要求。求公正的解决办法。在得到请求的情况下,各专业学院的院长,耶鲁学院院长,研究生院院长,或教务长将向认为拥有抱怨理由的教师推荐一名可以同其秘密商谈解决办法的教师或行政人员。提交院长。如果问题不能通过非正式的讨论解决,教师可以向相关院长’提交一份包含抱怨原因和解决办法的书面材料。(如果该教师认为该院长与事件争议的关键有关,则可以直接向教务长提交书面材料。如下。)该书面材料必须在最后决定做出后的45天内交给院长。但是,如果特殊情况允许,院长可以延长申述的时间。然后,院长§将进行ー项非正式的调查。在调查过程中,院长可以同该教师商讨并约见其它院长认为同解决办法相关的当事方。在同院长讨论的过程中,提出抱怨的教师可以请一位顾问6陪同,但是院长只能在得到抱怨教师同意的情况下オ可以单独同该顾问谈话。由院长开展的调查将在一段合理的时间期限内完成,一般在30天之内,最后将形成书面的对申述教师的答复意见。院长的书面答复意见中须告知申述教师其拥有如下所述委员会复审的权カ。提交教务长.当非正式商讨(尝试之后)或提交院长都未能解决问题,或院长与问题争论的关键有关,则当事人可以向教务长提交一份书面材料说明抱怨的原因和希望得到的解决办法,并应请求对其提出的抱怨重新考虑。这份书面材料的复印件将被提供给属于该抱怨的主要对象的个人。该书面材料必须在对最后决定做出后的45天内提交教务长,如果抱怨最初是向院长提出的,则该书面材料必须在院长向该教师给出书面答复后的两周内提交院长。教务长或由教务长指定的人员将对抱怨进行初步复审,并且在合适的情况下,将尝试通过非正式途径解决。教务长在收到抱怨申请后,应尽快,且在任何情况下都不得迟于ー个月,将教师所抱怨的没有解决的问题转给ー个复审委员会,除非教务长认为所提交的抱
14怨内容不在复审程序内或没有价值。复审程序.ー个复审委员会将对教务长提交的抱怨内容进行评价。文理科教4在文理科教授会,抱怨书应直接提交给担任聘任(期限或终生制)委员会主席的院长,续聘或晋升的意见由该黍吊ム伟责提出5这里或之后瓦及的院长可以指院长本人,或由院长的授权人,可以是个人或委员会。6对文理科教授会的教师成员来说,顾问可以是耶鲁大学任一学院或系的梯级教师。《教师手册》IV.A.10部分对梯级教师的级别做出了规定。对于其它教授会的教师来说,顾问可以是任一学院或系的全职教师。授会的复审委员会是ー个常设委员会,每年由教务长同文理科教授会执行委员会商定后任命,该委员会由4名文理科教授会的终身制教师和1名法学院教师组成。其中一人将被指定为某项具体复审问题的主席。其它学院有关教师聘任问题的复审委员会由5名终身制教师成员(在音乐学院和戏剧学院,这些成员可以是教授的助手)组成,其中2名成员从文理科教授会常设复审委员会成员中选出,另外3名成员由教务长指定来审查某项具体的抱怨。委员会成员如果本身涉及抱怨内容的在委员会复审过程中主动回避。如果有成员回避或由于其它原因不能参加复审,教务长指定新人代替。在调查过程中,复审委员会有权查看校内各部门中与抱怨有关的材料和在做出教师所抱怨的决定前准备的材料。但是复审委员会不得查看受法律保护的材料(如,精神病患者记录和律师ー委托人通信记录)。学校希望耶鲁共同体的所有成员都要完全配合复审委员会的调查。诉讼不应被当作是敌对性的。提出抱怨的教师必须同复审委员会见面,在此过程中可以有一名顾问陪同。抱怨教师和被告都将有机会提供相关信息并向复审委员会提出询问相关证人。抱怨教师和被告可以被允许查看全部或部分委员会认为与具体抱怨内容直接相关的材料,或由于涉密而未被公开的材料。随着调查的开展,复审委员会可以询问由抱怨教师或被告提出的有关证人,或其它委员会认为相关的人员。复审委员会可以根据自己的判断,不论抱怨教师和其顾问是否在场,开展调查。复审委员会只有在争得抱怨教师同意的情况下,方可与该教师的顾问单独交流。如果抱怨声称在续聘或晋升问题中有性别歧视或歧视残疾现象,复审委员会也将分别同耶鲁大学第九条协调员(TitleIXCoordinator)和负责残疾学生和雇员的资源的咨询委员会主席商议。复审委员会在经过调查之后,在最后一次会议上将就整个问题进行商讨,并形成一份说明事实发现并得出结论的书面报告。在该报告的单独一个部分,如果有的话,复审委员会将列出ー些推荐教长应该采取的行动的要点。该报告只有在大多数参与事件调查的委员会成员投票通过的情况下才能被采纳。裁决。复审委员会将在一段合理的时间限度内提交复审报告,通常在收到抱怨书之日起90天内。(一般的,该报告将被直接提交给教务长,但是如果复审委员会认为教务长是事件争议中的关键,则该报告将有复审委员会提交给校长,由校长代替教务长对抱怨做出裁决。)
15该报告是向教务长提交的一份咨询性报告,其它任何人都无权得到次报告的复印件.但是,教务长可以允许抱怨教师和被告查看报告的事实发现部分和总结部分(但不包括委员会的推荐意见),并予以评价。教务长须接受委员会对于事实发现的报告。教务长可以接受,修改或驳回委员会所作出的总结或任何推荐意见。但是在任何情况下,教务长都可以保留采取复审委员会所推荐的行动,在最后决定做出之前,教务长将同复审委员会讨论并说明其有不同意见的原因。然后,教务长将对该事件做出决定,并将决定以书面形式告知提出抱怨的教师,复审委员会,被告,以及(如果适当)相关的聘任委员会。教务长的决定一般应在教师向教务长提交书面抱怨材料后的90天内给出。如果有时需要额外的时间(例如,在夏季月份教师休假引起的延迟),教务长可以延长做出决断的日期。如果该时间被延长,教务长须告知教师和被告。由教务长做出的支持对某教师不续聘或不晋升的决定将是最重的结果。由教务长做出的其它决定将依照学校的规定或惯例执行。(例如,教务长有可能挑选成员组成一个特别委员会。)M.有关除续聘或晋升之外的抱怨问题的复审程序耶鲁大学任一教学类或研究类教师认为由于学校对某项大学政策的违背(如,由于种族、肤色、宗教信仰、性别、性取向、残疾、年龄、民族或人种原因受到歧视),而使其受到伤害,但与续聘和晋升无关的,可以参照上述IILL.3中7的规定,申请对其抱怨进行复审。但是,如果该抱怨被提交给一个委员会进行复审,教务长可以根据自己的判断,将该抱怨提交给还是上述的常设复审委员会或由教务长任命的由至少3人组成的特别调查组。由教务长做出的针对本节中提出的抱怨内容的决定将成为最终结果。7除医学院外的志愿教师外,耶鲁大学所有教师都可以获得这些程序。IV.针对各教授会的教师级别、聘任及政策
16V.研究聘任:全校范围A.基本政策研究聘任面向拥有博士或硕士学位,或接受过同等培训的个人。研究级别分为三类,非教师类别有两类,即博士后聘任人员(postdoctoralappointees)和研究助手。在下面有对他们的描述。对任何研究人员来说,教学并不是必须的,但是兼职教学是允许的。要求进行教学的研究人员可以作为讲师或教师助手予以聘任。在这种情况下,该个人的部分薪水可以通过教学自己预算予以支付,但是由于研究人员本身都是以全职形式雇用的,所以其薪水的总和不能由于进行教学而有所增加。当教学教师岗位出现空缺,需要在全国范围内招聘时,研究人员的能力,成果和经历将成为他们被考虑成候选人的依据。当首席研究员(principalinvestigator)得到有关补助金的任何变化的信息后,要尽快将消息通知由补助金支付工资的研究员。因为这对判断研究员的聘任长度和雇用的时间段和持续时间是十分重要的。B.级别描述1.研究型教师级别拥有副研究科学家/学者(副研究员),研究科学家/学者(研究员),或高级研究科学家/学者(高级研究员)级别的人员被看作为研究型教师。在大部分情况下,他们都是学校的雇员,如果是以至少半日工作量(half-time)聘用的,则可以享受附加福利并有资格参加耶鲁大学退休年金计划。在耶鲁医学院,有些研究型教师是受雇于西黑文老兵医院(WestHavenV.A.Hospital),耶鲁ー纽黑文医院,霍华德・休斯医学研究所或皮尔斯基金会的,他们所享受的附加福利也可能根据薪水的来源不同而不同。如此雇用的研究型教师成员须同院长商量此类问题。总的说来,属于全职雇用的耶鲁大学研究型教师有资格享受与梯级教师相同的福利,包括教职エ子女奖学金计划,抵押贷款项目,产假,看护假等,但是不包括针对拥有教学任务的教师的孕妇政策,也不包括VILD部分描述的聘任期的延长。研究型教师也有权使用教学类教师关于要求对不续聘或不晋升决定进行复审的程序,除非该决定与拨款的终止或补助金的不再延续有关。全职的研究型教师级别为研究科学家/学者或高级研究科学家/学者的,在系主任和院长的
17同意的情况下,可以作为首席研究员申请研究补助金。此类批准不是自动的,而要求之前要有系主任和院长提供研究空间和其它支持的许诺。全职副研究科学家/学者和兼职研究型教师,如果是各专业学院的,必须院长得到院长的特别许可,如果是文理科教授会的,则必须得到教务长的特别许可后,才能作为补助金的首席研究员。但是在有些情况下,此类特别允许的权力被委任给系主任。各系可以邀请研究科学家和高级研究科学家参加教师会议。他们虽无权就有关梯级教师的聘任问题投票,但是如果系里同意,他们可以就同级别以下(含相同级别)研究型教师的聘任问题投票,但他们无权对与他们同级的研究型教师的续聘投票。副研究科学家/学者。该聘任一般面向与某教师合作或作为某个研究小组成员从事学术或科学研究的个人。此类个人一般应至少拥有两年作为博士(或同等学力)的研究经历,在相关项目或领域已经显示出其学术能力,并可预期其可以为某系的项目研究做出贡献。该级别的聘任期限为1年,可以续聘。可以以最长三年时间为ー个阶段对任职者的研究进行考核,以确定其是否能晋升研究员科学家/学者。在文理科教授会,该级别的聘任推荐由各系主任向教务长提交。在各专业学院,该级别的聘任必须经由聘任所发生的学院的院长或院长的委托人批准。对下述两个研究型教师级别的聘任须得到相应的聘任委员会的批准。学校要求参照教学类教师的聘任办法对候选人的资进行全面的评审。研究科学家/学者。该聘任面向作为高水平学者或某ー研究小组高级成员从事学术或科学研究的个人。该级别的聘任期限最高可以为3年(可续聘),以可获得外部薪金支持为条件。外部薪金支持如在预期的结束时间终止,则不需要事先通知,如果原先预计的经费支持在任期内终止,则须提供提前一年的书面通知。任职者为晋升高级研究科学家/学者必须接受评审,评审时间跨度最长为5年。研究科学家/学者级别的聘任推荐由系主任向相应的聘任委员会提交。在文理科教授会,此类聘任由期限聘任委员会审查;在医学院,由期限聘任和晋升委员会审查。各专业学院的聘任程序已在第奥部分的相关部分被描述。高级研究科学家/学者。该聘任适合于具有髙专业水准和突出能力,并在重大研究项目中起关键作用的个人。该级别聘任的期限最高可以为5年(可续聘)。报酬支持的期限可以比聘任期限短,但是需要以能获得外部资金支持为条件。外部薪金支持如在预期的结束时间终止,则不需要事先通知,如果原先预计的经费支持在任期内终止,则必须在当前任期内预计的经费支持终止前至少提前两年给出书面通知。该级别的聘任推荐由系主任向相应的聘任委员会提交。在文理科教授会,此类聘任由终身聘任委员会负责审查;在医学院,由期限聘任和晋升委员会负责审查。各专业学院的聘任程序已在第口し部分的相关部分被描述。下述两类研究聘任不属于教师级别。
181.博士后聘任人员博士后聘任是为新近的博士学位(或同等学历的高级学位)的获得者提供ー段延长教育和专业训练的时间。聘任人员分为两类:博士后研究员(postdoctoralfellows)和博士后合作人(postdoctoralassociates)。这两者的不同在绝大多数情况下是由于支持经费的来源不同。被聘任者的研究经费来源于由耶鲁大学管理的补助金或合同的,一般被称为博士后合作人,他们尽管被看做是受训者(实习生),但属于耶鲁大学的雇员。博士后研究员也是受训者,但是他们不是耶鲁大学的雇员。他们的经费要么来自于拨给学校的培训补助金,要么直接来自于某个外部资金源。若被聘任者的经费来源为耶鲁大学,但既不属于研究基金也不属于培训补助金的,可以归为博士后合作人,也可以归为博士后研究员。但是如果该被聘任者是被要求耶鲁大学服务的,则必须归为博士后合作人。个人在这两个级别的时间总和不得超过4年。在特殊情况下,在各专业学院经院长批准,在文理科教授会由教务长批准,可以将期限延长,但是作为博士后聘任的总年数不得超过6年。有关博士后聘任人员的聘任期限和程序在《耶鲁大学博士后聘任人员政策》中有具体规定。每一次新的博士后聘任决定都以聘任信的形式做出,聘任信由ー名监督教师书写,要写明聘任的详细情况,并须得到系主任,院长或教务长或他们的委托人的批准。这个监督教师将成为该博士后聘任人员的导师,该教师要对该博士后进行培训,监督,并且要以年为单位,及时清楚的对该博士后的表现或进步做出书面的鉴定报告。导师有义务为博士后聘任人员提供一段受教育的博士后经历并为其之后的职业做好准备。博士后聘任人员的职责包括:⑴完成具体的研究和培训目标;(ii)遵守学校关于研究的道德规范;(iii)遵守联邦、州和地方制定的有关以人为对象进行研究(humansubjectsresearch)、关心和使用实验室动物、使用危险品等方面的规定;(iv)遵守学校的所有相关政策;以及(v)对研究结果进行适当地记录和备案。如果聘任人员还将从事其它活动,如教学,则应在当时的聘任信中或此后的书面材料中列出.博士后聘任人员可以参加由与所在单位相关的学院,如研究生院,主办的教师培训。博士后聘任人员也可以参加由与所在单位相关的学院,如研究生院,主办的职业发展研修班或其他活动(仅为学位学生设计的面试活动除外)。全职聘任的博士后人员,可以最多按平均每周(7天)有1天时间从事校外的雇用活动,如顾问或咨询。此类活动必须符合学校的相关政策,包括关于利益冲突,义务冲突(conflictofcommitment),和知识产权等的政策。另外,此类雇用应同导师商议,必须不得妨碍主要的研究和培训义务,同时还必须符合经费来源方的规定。在得到导师和经费来源方的同意后,博士后聘任人员可以通过在耶鲁大学或其它单位进行
19教学,得到除定期补助外的薪水补偿,但是每年的授课量不得超过ー门。这对于适用于教师和员エ的关于在其它教学单位教学不能得到额外补偿的规定是ー个例外情况。该例外是被允许的,因为教学工作一般与博士后聘任的要求无关,但是参与教学活动可以为博士后聘任人员提供重要的专业经验和培训。任何教学活动都必须符合上述时间限制。如果个人认为其受到的待遇违反了学校政策,或认为受到了歧视,或认为由于犯错而得到了不恰当的惩罚,可以使用博士后聘任人员申述程序(GrievanceProcedureforPostdoctoralAppointees)。关于学术舞弊和科学造假的抱怨必须依照“耶鲁大学处理学术舞弊事件的政策和程序”进行。博士后研究员的定期生活津贴是要上税的,但不用缴纳社会安全税。美国公民或居民的定期生活津贴虽然是应纳税的,但不能扣缴。因此,美国公民或居民可能需要按季度估计报税,以避免缴税不足的惩罚。除非税务条款另有规定,非美国居民的外国人所得的定期生活津贴将按照降低后的学生税率作为所得税进行扣缴。博士后合作人虽然不是教师,但是是耶鲁大学的雇员,因此须缴纳联邦所得税和社会安全/医疗预扣所得税。有关博士后聘任人员的福利在VIILD&中描述。1.助理研究员助理研究员的聘任面向拥有博士学位,或接受过同等培训的,同某教师或某一研究小组成员合作开展学术或科学研究的个人。此类个人一般应至少拥有两年作为博士(或同等学力)的研究经历,在相关项目或领域的研究已经证明其在所在专业领域已具备较高的专业水平。该受聘人员不通过由耶鲁大学管理的资金提供报酬,不属于耶鲁大学的雇员。但是,助理研究员同教师ー样有资格借阅图书馆的书籍。该级别的聘任在各专业学院由相应的院长批准,在文理科教授会由教务长批准。VI.客座聘任(VisitingAppointments):全校范围A.基本政策其它学术单位的教师经常会被邀请到耶鲁大学从事一学期或一学年的教学工作,而且很少会有超过一年的情况。带薪聘任的时长为一学期或以上的访问教师有资格享受健康福利,而且在特殊情况下,还可享受退休金扣款。(参见VIII.D.2)在已建立的大学或学院拥有学术教学聘任
20岗位的个人,被邀请到耶鲁大学客座讲学期间,将被授予与原单位相同的或相当的学术头衔。只有建筑学院例外,建筑学院的客座教师如果当前在另外的单位没有学术级别将被聘任为讲师。学校几乎很少聘用在耶鲁大学聘任期间仍接受其它单位全职聘任的客座教师。如果特殊情况要求聘任一名兼职客座教师,则在聘任决定做出之前,必须得到耶鲁大学教务长的批准和该客座教师原单位院长或教务长的批准。B.客座研究教师该类别是为附属于其它单位的人员准备的,这些人员在有限的一段时间限度内参与由耶鲁大学管理的受助研究项目对双方都有利.此类人员一般应在获得博士学位(Ph.D.,M.D.)或同等学历后有两年以上研究经历。受聘人员的经费一般由耶鲁大学管理的的补助金或合同基金支出。客座教师的薪水不能超过其所在原单位原来提供的薪水。耶鲁大学授予客座教师的学衔同其在原单位的学衔想当,只是增加了“客座”这样ー个前缀。在文理科教授会,客座研究科学家/学者的聘任必须得到教务长办公室的批准;在各专业学院,必须得到院长的批准。C.客座研究员(VisitingFellow)该头衔是给予已确定的学者和其它杰出个人的,如在休假期的其它学校的教师,政府官员,新闻记者,作家和其他类似人员,在一段有限的时间内,他们与学校的合作以及在耶鲁居住对双方都有利。客座研究员既不属于学校的教师,也不属于学校的雇员,没有关于教学或工作的要求。他们不享受耶鲁大学提供的补偿,因此也没有资格参加耶鲁大学的附加福利计划。VII.休假:全校范围耶鲁对于支持教师的研究兴趣和专业发展的承诺体现在下面所描述的教师可拥有的休假的机会。所有的带薪休假的工资由学校资金支付,大部分不带薪的休假由校董会授权后批准,其目的是研究,或允许教师利用学术机会在一段较短的时间内脱离正常职责。在有些情况下,在教师休假期间,学校将继续使用耶鲁资金(包括综合拨款,捐赠,或ー项补助金或合同)向教师支付全额或部分薪水或附加福利。在其它情况下,全额或部分的薪水将由外部的研究基金或其它单位负担,例如,当教师拥有客座聘任时。在本部分所提到的由学校资金全额或部分支付薪水的休假均为带薪休假,而在休假期间,教师薪水完全由外部资金源承担的,被称为无薪休假。

62a.IftheCommitteedeterminesthatafacultymember'sinvolvementwithanenteipriseentails,orislikelytoentail,aconflictofinterest,thentheCommitteewillconsultwiththefacultymemberinordertoseekwaystoeliminateormanagetheconflict.b.IftheCommitteedeterminesthatafacultymember'sinvolvementwithanenterpriseentails,orislikelytoentail,aconflictofcommitment,thenthemattershouldbereferredtotheProvostandtothedeanforfacultyinprofessionalschools.Thefacultymembermayrequestandreceiveaone-year,half-timeappointmentwithappropriatereductioninobligationstoandfromtheUniversitytodevotetheothertimetothenon-academiccommitment.Alternatively,theindividualmayrequestleavewithoutpayforoneyear.SuchrequestswillbeactedonbytheProvostafteranassessmentofinstitutionalneeds.Attheendofanyapprovedone-yearleaveorperiodofreducedresponsibility,thefacultymembermayreturntofull-timestatus.Ifthefacultymemberwishestocontinuetodevotesubstantialtimetothecommercialendeavor,theindividualwillnormallybeexpectedtoresignfromtheUniversity.Subsequentreappointmenttofull-timestatusrequiresapplicationandapprovalthroughtheUniversity'sordinaryfacultyappointmentprocedures.Thefacultymembermayalsorequestconversiontopart-timeadjunctstatus,butsubsequentreappointmentwouldsimilarlyinvolvetheusualUniversityappointmentprocedures.c.Afterreviewoftheproposaland,whereappropriate,modificationsthroughdiscussionswiththefacultymember,theCommitteewillrecommendtotheProvostandtothedeanforfacultyinprofessionalschoolsoneofthefollowingthreecoursesofaction:(i)acceptanceoftheproposal;(ii)acceptancesubjecttoamanagementplan;or(iii)rejectionoftheproposalbecauseofconflictwithUniversitypolicies.Explicitapprovalisrequiredbeforethefacultymembermayassumetheproposedposition.d.Whenafacultymemberhasanongoingrelationshipwithaprivateenterprise,heorshemustprovideinformationtotheCommitteeonthestatusofthatrelationshipatleastonayearlybasisandmorefrequentlyifthereisachangeintherelationship,orwheneveritisrequestedbytheCommittee,adeanortheProvost.NoticeoftherelationshipmustalsobeprovidedtothecognizantOfficeofGrants&Contracts

65underthegrievanceproceduresofthestudent'sschoolorundertheProvost'sProcedureforStudentcomplaints.Astaffmember'scomplaintofsexualharassmentbyafacultymembermaybereviewedundertheappropriatestaffgrievanceprocedures.FacultymemberswhobelievetheyhavebeensexuallyharassedmayusethecomplaintreviewproceduredescribedinSectionIII.LorIII.M.Anyfacultymemberconcernedaboutanissueofsexualharassmentisencouragedtodiscussitwiththedeanofhisorherschool,theOfficeoftheProvost,ortheschool'sorUniversity,sTitleIXCoordinator.B.师生相互的自愿男女关系(Teacher-StudentConsensualRelations)Theintegrityoftheteacher-studentrelationshipisthefoundationoftheUniversity'seducationalmission.Thisrelationshipvestsconsiderabletrustintheteacher,who,inturn,bearsauthorityandaccountabilityasamentor,educator,andevaluator.Theunequalinstitutionalpowerinherentinthisrelationshipheightensthevulnerabilityofthestudentandthepotentialforcoercion.ThepedagogicalrelationshipbetweenteacherandstudentmustbeprotectedfrominfluencesoractivitiesthatcaninterferewithlearningconsistentwiththegoalsandidealsoftheUniversity.Wheneverateacherisresponsiblefordirectlysupervisingastudent,asexualrelationshipbetweenthemisinappropriate.Anysuchrelationshipjeopardizestheintegrityoftheeducationalprocessbycreatingaconflictofinterestandmayleadtoaninhospitablelearningenvironmentforotherstudents.Therefore,noteachershallhaveasexualrelationshipwithastudentoverwhomheorshehasdirectsupervisoryresponsibilities,regardlessofwhethertherelationshipisconsensual.Teachersmustavoidsexualrelationshipswiththeirstudents,includingthoseforwhomtheyarelikelytohavefuturesupervisoryresponsibility.Conversely,teachersmustnotdirectlysuperviseanystudentwithwhomtheyhaveasexualrelationship.Violationsoforfailuretocorrectviolationsoftheseconflictofinterestprinciplesbytheteacherwillbegroundsfordisciplinaryaction.Teachersorstudentswithquestionsaboutthisconflictofinterestpolicyareadvisedtoconsultwiththedepartmentchair,theappropriatedean,theProvost,oroneoftheirdesignates.Iftheissuecannotberesolvedinformally,astudentmaylodgeaconflictof
