1、COMMUNITYDEVELOPMENTBLOCKGRANTLOANAGREEMENTNORTHDAKOTADIVISIONOFCOMMUNITYSERVICESSFN51604(10/00)DateTheCity/Countyof(LENDER)and(BORROWER)agreetoaloanpursuanttotheCommunityDevelopmentBlockGrantprogram(CDBG)authorizedbythefederalDepartmentofHousingandUrb

2、anDevelopment(HUD)andasadministeredandapprovedbytheDivisionofCommunityServices(DCS),subjecttothefollowingtermsandconditions,includingattachments:ARTICLE1.0-GENERAL1.1Definitions1.2TheLoanLENDERagreestolendBORROWERanamountuptodollars($)toassistinthefina

3、ncingoftheproject(s)describedinArticle2.3ofthisAgreement.BORROWERshallexecuteaPromissoryNotetoLENDERinanamountequaltothemaximumamountofthisloan,dollars($)withinterestontheunpaidbalanceat%annually.ThePromissoryNoteisAttachment"A"tothisagreement.Intheeve

4、ntBORROWERdoesnotrequirethemaximumamountofthisloan,anyfundsundisbursedbyLENDERshallreducetheloanaccordingly.1.3TimeofPerformanceTheprojectdescribedinArticle2.3shallbecompletedonorbefore.1.4ReportandProductsBORROWERshallsubmitthefollowingreports:1.Emplo

5、ymentReport/LoanStatus-Submittedonasemi-annualbasisthroughoutthetermoftheloan.Thefirstreportshallbesubmittednolaterthansixty(60)daysafterthedisbursaloftheloan.2.3.1.5IntendedThirdPartyBeneficiaryTheDCSisan"IntendedThirdPartyBeneficiary"ofthiscontractan

6、dassuch,islegallyentitledtoenforcethisagreement.Inparticular,itisexpresslycontemplatedbythecontractingpartiesthattheDCSwillhavetheauthoritytoenforcethe"EventsofDefault"(6.4)and"ActionsUponaDeclarationofDefault"(6.5)provisionsofthisAgreementiftheLENDERd

7、oesnotexercisetherightsofArticles6.4and6.5.ThisprovisioninnowayrestrictsanylegalrightsorremediesthattheDCSmayassertagainstthe(city/county)foritsfailuretoenforcetheconditionsandrequirementsofthisagreement.ARTICLE2.0-BORROWER'SPROJECT(S)2.1LocationofProj
