2、tstotheRulesfortheCapitalInvestmentEntrantScheme(“SchemeRules”)willcomeintoeffecton14October2010(“commencementdate”)andareapplicabletoanapplicant/entrantwhoseapplicationundertheCapitalInvestmentEntrantScheme(CIES)isreceivedbytheImmigrationDepartmentonorafterth

3、ecommencementdate:-i)Thethresholdofinvestment(andNetassets/Netequityrequirement)tobecomeeligibleforApproval-in-PrincipleorFormalApproval,asthecasemaybe,israisedtoHK$10million;andii)“Realestate”asdefinedinparagraph4.1(a)oftheSchemeRulesshallbesuspendedtemporari

4、lyasaclassofPermissibleinvestmentassets(PIA)undertheCIES,andaslongasthesuspensionisineffect“Realestate”shallnotberegardedasaclassofPIAundertheCIESandtheSchemeRulesshallbeinterpretedaccordingly.2.Fortheavoidanceofdoubt,theaboveamendmentswillNOTaffectapplication

5、sundertheCIESreceivedbytheImmigrationDepartmentbeforethecommencementdate,includingthosethathavebeenapprovedorarestillunderprocessing.Forthesecases,theSchemeRulesprevailingBEFOREthecommencementdatecontinuetoapply.3.Furthermore,asatransitionalarrangement,newappl

6、icationsinvolvinginvestment(includingrealestate)ofnolessthanHK$6.5millionmadewithinsixmonthsimmediatelyprecedingthecommencementdate(i.e.14Aprilto13October2010)areeligibleforapproval,subjecttotheapplicantmeetingtheothercriteria.Fortheseapplicants,theSchemeRules

7、prevailingBEFOREthecommencementdateapply.Anyinvestmentinrealestatecompletedonorafterthecommencementdate,irrespectiveoftheamount,willnotbeacceptedasPIAfornewapplicationsundertheCIES.4.Paragraph5.1(b)(ii)oftheSchemeRulesisamendedwitheffectfromthecommencementdate

8、topermitaninsurerauthorizedtocarryonClassCbusinessasspecifiedinPart2oftheFirstScheduletotheInsuranceCompaniesOrdinance(Cap41)toactasafinancialintermediaryforthepurposeoftheCIES.Thi
