1、TRADEMARKPOST-DELEGATIONDISPUTERESOLUTIONPROCEDURE(TRADEMARKPDDRP)4JUNE20121.PartiestotheDisputeThepartiestothedisputewillbethetrademarkholderandthegTLDregistryoperator.ICANNshallnotbeaparty.2.ApplicableRules2.1ThisprocedureisintendedtocoverTrademarkpost-delegationdis

2、puteresolutionproceedingsgenerally.TotheextentmorethanoneTrademarkPDDRPprovider(“Provider”)isselectedtoimplementtheTrademarkPDDRP,eachProvidermayhaveadditionalrulesthatmustbefollowedwhenfilingaComplaint.ThefollowingaregeneralprocedurestobefollowedbyallProviders.2.2Int

3、heRegistryAgreement,theregistryoperatoragreestoparticipateinallpost-delegationproceduresandbeboundbytheresultingDeterminations.3.Language3.1ThelanguageofallsubmissionsandproceedingsundertheprocedurewillbeEnglish.3.2Partiesmaysubmitsupportingevidenceintheiroriginallang

4、uage,providedandsubjecttotheauthorityoftheExpertPaneltodetermineotherwise,thatsuchevidenceisaccompaniedbyanEnglishtranslationofallrelevanttext.4.CommunicationsandTimeLimits4.1AllcommunicationswiththeProvidermustbesubmittedelectronically.4.2Forthepurposeofdeterminingth

5、edateofcommencementofatimelimit,anoticeorothercommunicationwillbedeemedtohavebeenreceivedonthedaythatitistransmittedtotheappropriatecontactpersondesignatedbytheparties.4.3Forthepurposeofdeterminingcompliancewithatimelimit,anoticeorothercommunicationwillbedeemedtohaveb

6、eensent,madeortransmittedonthedaythatitisdispatched.4.4Forthepurposeofcalculatingaperiodoftimeunderthisprocedure,suchperiodwillbegintorunonthedayfollowingthedateofreceiptofanoticeorothercommunication.4.5Allreferencestodaylimitsshallbeconsideredascalendardaysunlessothe

7、rwisespecified.5.Standing5.1Themandatoryadministrativeproceedingwillcommencewhenathird-partycomplainant(“Complainant”)hasfiledaComplaintwithaProviderassertingthattheComplainantisatrademarkholder(whichmayincludeeitherregisteredorunregisteredmarksasdefinedbelow)claiming

8、thatoneormoreofitsmarkshavebeeninfringed,andtherebytheComplainanthasbeenharmed,bytheregistryoperator’smannerofoperationoruse
