1、中文摘要随着经济的发展，环境问题日益严重，我国1997年刑法以专节的形式规定了“破坏环境资源保护罪”，这足以显示，我国对环境保护的重视。但由于我国环境刑事立法起步较晚，环境犯罪时有出现，就目前来看，我国环境刑事立法存在明显不足，亟需完善。本文分四章对环境犯罪进行阐述：第一章，对环境及环境犯罪概念的界定。通过对环境及环境概念的界定明确了环境犯罪的特点及构成要件，提出了环境犯罪的客体是环境权。第二章，对国外环境刑事立法的介绍。分析了各国环境刑事立法的特点及国际环境犯罪的发展趋势，为我国借鉴国外环境刑事立法作铺垫。第三章，对我国环境刑事立法的分析。分析了我国环境刑事立法的现
