1、中文摘要买卖合同是经济全球化格局当中使用最为普遍的合同，与之相关联的风险负担制度便成为合同法的中心问题之一，世界各国的立法均对此制度给予了高度重视。在我国的合同法中，虽然有关于买卖合同标的物风险负担的相关规定，但由于规定的内容并不全面，致使在实践过程中，给当事人运用法律维护自身的合法权益造成了一定的困难。本文首先对风险的概念、特点、风险事由的范围进行界定。同时，对于目前存在的三大立法模式进行逐一评析，通过比对总结出相应模式的优缺点。其次，将各国关于买卖合同标的物风险负担一般规则与特殊规则的立法规定进行了详细梳理。再

2、次，也是本文的最大亮点在于，通过实证分析的方法，引出目前我国关于买卖合同标的物风险负担规则的争议焦点，侧重对“风险负担的前提”、“违约时标的物JxL险负担规则”、“路货买卖时标的物JxL险负担规则”和“涉及运输时风险负担规则”这四类情况进行分析，将外国先进立法规定与我国立法规定相比较，进而发现我国《合同法》关于标的物风险负担规定之不足，并提出相应的完善建议，以期能够对理论和实践起到一定促进作用。关键词：风险；风险负担；买卖合同：交付主义黑龙江大学硕士学位论文AbstractThecontractofsaleisth
