1、AGREEMENTONIMPORTLICENSINGPROCEDURESMembers,HavingregardtotheMultilateralTradeNegotiations;DesiringtofurthertheobjectivesofGATT 1994;Takingintoaccounttheparticulartrade,developmentandfinancialneedsofdevelopingcountryMembers;Recognizingtheusefulnessofauto

2、maticimportlicensingforcertainpurposesandthatsuchlicensingshouldnotbeusedtorestricttrade;RecognizingthatimportlicensingmaybeemployedtoadministermeasuressuchasthoseadoptedpursuanttotherelevantprovisionsofGATT 1994;RecognizingtheprovisionsofGATT 1994asthey

3、applytoimportlicensingprocedures;DesiringtoensurethatimportlicensingproceduresarenotutilizedinamannercontrarytotheprinciplesandobligationsofGATT 1994;Recognizingthattheflowofinternationaltradecouldbeimpededbytheinappropriateuseofimportlicensingprocedures

4、;Convincedthatimportlicensing,particularlynon-automaticimportlicensing,shouldbeimplementedinatransparentandpredictablemanner;Recognizingthatnon-automaticlicensingproceduresshouldbenomoreadministrativelyburdensomethanabsolutelynecessarytoadministertherele

5、vantmeasure;Desiringtosimplify,andbringtransparencyto,theadministrativeproceduresandpracticesusedininternationaltrade,andtoensurethefairandequitableapplicationandadministrationofsuchproceduresandpractices;Desiringtoprovideforaconsultativemechanismandthes

6、peedy,effectiveandequitableresolutionofdisputesarisingunderthisAgreement;Herebyagreeasfollows:Article1GeneralProvisions1.ForthepurposeofthisAgreement,importlicensingisdefinedasadministrativeproceduresThoseproceduresreferredtoas"licensing"aswellasothersim

7、ilaradministrativeprocedures.usedfortheoperationofimportlicensingregimesrequiringthesubmissionofanapplicationorotherdocumentation(otherthanthatrequiredforcustomspurposes)totherelevantadministrativebodyasapriorconditionforimportationintothecustomsterritor

8、yoftheimportingMember.2.MembersshallensurethattheadministrativeproceduresusedtoimplementimportlicensingregimesareinconformitywiththerelevantprovisionsofGATT 1994includingitsannexesandprotocols,asinterpretedbythisAgreement,
