3、esthattheyarecapableandfinanciallystabletoenterintothisagreementanddischargetheirobligationswithcommitmenttodeliverperformanceinaccordancewiththetermsandconditionshereinobtainedinthisagreement.TheLesseedesirestoleaseSBLCfromtheProvider.Lesseeconfirmswithfullcorporateandlegalres

4、ponsibilitythatfundsavailabletofulfilltherequirementsfortheleaseofthisinstrumentisreadyandLesseefurtherconfirmtocooperatewiththeProvider.WHEREAS.TheProviderdesirestolease,transferandassignallrightstitleandinterestoftheBGavailabletoittotheLessee.Providerrepresentsandwarrantsthat

5、ithastheabilityandresourcetoarrangethroughassociates,contractsandsources,withfullcorporateresponsibility,financialinstrumentinthetermofassignmentstobeprovidedtoLessee・ProviderherebydeclaresunderpenaltyofpeijurythattheSBLCwillbebackedbyfundsthataregood,clean,clear,andfreeofnoncr
