1、ForNewTechnologyNetworkRcorporationPlummerBlocksCAT.NO.2500/EWarrantyNTNwarrants,totheoriginalpurchaseronly,thatthedeliveredproductwhichisthesubjectofthissale(a)willconformtodrawingsandspecificationsmutuallyestablishedinwritingasapplicabletothecontract,and(b)befreefromdefectsinmaterialo
2、rfabrication.Thedurationofthiswarrantyisoneyearfromdateofdelivery.Ifthebuyerdiscoverswithinthisperiodafailureoftheproducttoconformtodrawingsorspecifications,oradefectinmaterialorfabrication,itmustpromptlynotifyNTNinwriting.InnoeventshallsuchnotificationbereceivedbyNTNlaterthan13monthsfr
3、omthedateofdelivery.Withinareasonabletimeaftersuchnotification,NTNwill,atitsoption,(a)correctanyfailureoftheproducttoconformtodrawings,specificationsoranydefectinmaterialorworkmanship,witheitherreplacementorrepairoftheproduct,or(b)refund,inpartorinwhole,thepurchaseprice.Suchreplacementa
4、ndrepair,excludingchargesforlabor,isatNTN'sexpense.AllwarrantyservicewillbeperformedatservicecentersdesignatedbyNTN.Theseremediesarethepurchaser'sexclusiveremediesforbreachofwarranty.NTNdoesnotwarrant(a)anyproduct,componentsorpartsnotmanufacturedbyNTN,(b)defectscausedbyfailuretoprovidea
5、suitableinstallationenvironmentfortheproduct,(c)damagecausedbyuseoftheproductforpurposesotherthanthoseforwhichitwasdesigned,(d)damagecausedbydisasterssuchasfire,flood,wind,andlightning,(e)damagecausedbyunauthorizedattachmentsormodification,(f)damageduringshipment,or(g)anyotherabuseormis
6、usebythepurchaser.THEFOREGOINGWARRANTIESAREINLIEUOFALLOTHERWARRANTIES,EXPRESSORIMPLIED,INCLUDINGBUTNOTLIMITEDTOTHEIMPLIEDWARRANTIESOFMERCHANTABILITYANDFITNESSFORAPARTICULARPURPOSE.InnocaseshallNTNbeliableforanyspecial,incidental,orconsequentialdamagesbaseduponbreachofwarranty,breachofco
