3、cialrights.Secondly;peopleinwesterncountriesbelieveliberalismandindividualism,sothattheymaintainsharpvigilancewithregardtothegovernment'sactionswhichareinthenameofprotectingtheirsocialrights.Thirdlythetraditionalsystemsofremedyandprotectionoffundamentalrightsisnotsuitabl

4、etoforsocialrights.Theremedyandprotectionofsocialrightshasparticularityduetothefactthatcitizenswillhaveanexpectancewhichishighinmacroscopyanddifferentinmicroscopicviewandgovernmentisnotabletomeetpeople'sexpectance.Thedualcharacterstheoryoffundamentalrightsisaveryimportan

5、tpartofconstitutiontheory.Itissignificanttostudytheremedyandprotectionofsocialrightsontheviewofdualcharacterstheoryoffundamentalrights.Accordingtothedualcharacterstheoryoffundamentalrights,ontheonehand,socialrightshavepropertyofsubjectiverightsandfunctionsofobjectiverigh

6、ts.Thepointisthelitigablenature.IntheGrootboomCaseinSouthAfrica,theConstitutionalCourthasappliedtheReasonablePolicyClaimwhichmakesagreatprogressinthedirectionofsubjectivefundamentalrights.Ontheotherhand,asobjectivelaworobjectivevalueorder,socialrightsneedgovernment'svolu
