2、HongKonginJuly2005.On10July2005,customsofficialsboardedthe"HuiXinHui28"(arivertradevessel)attheWesternQuarantineandImmigrationAnchorage.ThatvesselhadarrivedinHongKongfromBeijiao(nearShunde).Onboard,therewerefoundtwosealedcontainerseachwith420cartonsofwaterdispensers.Thecartonscontainedont

3、heirfacethewords"MadeinKorea"andthewaterdispensersthemselvesalsoborethisstatementonlabels.Whenthecontainerswereopened,thecartonsstuffedinthefrontrowallhadblueadhesivetapecoveringthewords"MadeinKorea".Thecargomanifestforthisshipmentnamedastheconsignee"香港美的家用電器有限公司"(XianggangMeideHouseholdE

4、lectricalAppliancesLimited).Thiswassaidtobeanon-existentcompany.Theshipagent,however,didnothavesightofthismanifestandsowasunawarethattheconsigneewasthisnon-existententity.Theshipagentandafeedercompanywerechargedwiththesection12(1)offenceoftheTradeDescriptionsOrdinance,Cap.362("theTDO").Th

5、atprovisionstates:"12.Prohibitedimportandexportofcertaingoods(1)Subjecttosection13,nopersonshallimportorexportanygoodstowhichafalsetradedescriptionorforgedtrademarkisapplied.(2)Anypersonwhoimportsorexportsanygoodscontrarytosubsection(1)commitsanoffenceunlessheprovesthat–(a)hedidnotknow,ha
