1、ADDIS-GINCHI-AMBOROADREHABILITATIONPROJECTAlterations,AdditionsandOmissions变更，增加和缺省Variations51.1TheEngineershallmakeanyvariationoftheform,qualityorquantityoftheWorksorany工程师可以根据他自己的意见，对认为适当的，或是必需的情况下，对工程的形式，质量或数量进行变更。他有权利指令承包商，并由承包商执行以下任何的工作内容：partthereofthatmay,inhisopinion,benecessaryandfo
2、rthepurpose,orifforanyotherreasonitshall,inhisopinion,beappropriate,heshallhavetheauthoritytoinstructtheContractortodoandtheContractorshalldoanyofthefollowing:(a)increaseordecreasethequantityofanyworkincludedintheContract,增加或减少合同内的工作量；(b)omitanysuchwork(butnotiftheomittedworkistobecarriedoutb
3、ytheEmployerorbyanothercontractor),省略去任何工作（但如果省略部分的工作是由业主或其他承包商来执行的话，则不包括再此部分中；）(c)changethecharacterorqualityorkindofanysuchwork,改变任何部分工作的性质，质量和种类；(d)changethelevels,lines,positionanddimensionsofanypartoftheWorks,改变任何部分工作的水平，线路，位置和尺寸；(e)changeanyspecifiedsequenceortimingofconstructionofanypa
4、rtoftheWorks.改变工程任何部分施工的特定顺序和时间；NosuchvariationshallinanywayvitiateorinvalidatetheContract,buttheeffect,ifany,ofallsuchvariationsshallbevaluedinaccordancewithClause52.ProvidedthatwheretheissueofaninstructiontovarytheWorksisnecessitatedbysomedefaultoforbreachofcontractbytheContractororforwhich
5、heisresponsible,anyadditionalcostattributabletosuchdefaultshallbebornebytheContractor.任何这样的变更都不在任何意义上减损或废止合同，但是，任何这样的变更都应按照条款52来进行价值评估。如果变更的原因是由于承包商自身的过失或单方违反合同造成的话，那么任何由此过失导致的附加费用都由承包商自己承担；InstructionsforVariations51.2TheContractorshallnotmakeanysuchvariationwithoutaninstructionoftheEngineer
6、.ProvidedthatnoinstructionshallberequiredforincreaseordecreaseinthequantityofanyworkwheresuchincreaseordecreaseisnottheresultofaninstructiongivenunderthisClause,butistheresultofthequantitiesexceedingorbeinglessthanthosestatedintheBillofQuantities.承包商在未收到工程师的指令前不应进行任何变更。但如果工程量的增加或减少不是由于本条款下工程师
