1、AMENDMENTOFAPPLICATION§2.71Amendmentstocorrectinformalities.Theapplicantmayamendtheapplicationduringthecourseofexamination,whenrequiredbytheOfficeorforotherreasons.(a)Theapplicantmayamendtheapplicationtoclarifyorlimit,butnottobroaden,theidentificationofgoodsand/orservices.(b)(1)Ifthedeclarationorver
2、ificationofanapplicationunder§2.33isunsignedorsignedbythewrongparty,theapplicantmaysubmitasubstituteverificationordeclarationunder§2.20.(2)Ifthedeclarationorverificationofastatementofuseunder§2.88,orarequestforextensionoftimetofileastatementofuseunder§2.89,isunsignedorsignedbythewrongparty,theapplic
3、antmustsubmitasubstituteverificationbeforetheexpirationofthestatutorydeadlineforfilingthestatementofuse.(c)Theapplicantmayamendthedatesofuse,providedthattheapplicantsupportstheamendmentwithanaffidavitordeclarationunder§2.20,exceptthatthefollowingamendmentsarenotpermitted:(1)Inanapplicationundersecti
4、on1(a)oftheAct,theapplicantmaynotamendtheapplicationtospecifyadateofusethatissubsequenttothefilingdateoftheapplication;(2)Inanapplicationundersection1(b)oftheAct,afterfilingastatementofuseunder§2.88,theapplicantmaynotamendthestatementofusetospecifyadateofusethatissubsequenttotheexpirationofthedeadli
5、neforfilingthestatementofuse.(d)Theapplicantmayamendtheapplicationtocorrectthenameoftheapplicant,ifthereisamistakeinthemannerinwhichthenameoftheapplicantissetoutintheapplication.Theamendmentmustbesupportedbyanaffidavitordeclarationunder§2.20,signedbytheapplicant.However,theapplicationcannotbeamended
6、tosetforthadifferententityastheapplicant.Anapplicationfiledinthenameofanentitythatdidnotownthemarkasofthefilingdateoftheapplicationisvoid.§2.72Amendmentstodescriptionordrawingofthemark.(a)Inanapplicationbasedonuseincommerceundersection1(a)oftheAct,theapplicantmayamendthedescriptionordrawingofthemark
7、onlyif:(1)Thespecimensoriginallyfiled,orsubstitutespecimensfiledunder§2.59(a),supporttheproposedamendment;and(2)Theproposedamendmentdoesnotmateriallyalterthemark.TheOfficewilldeterminewhetheraproposed
