1、论宪法司法化[论文摘要：]2001年，最高人民法院就齐玉苓以受教育权被侵害为由而起诉所作出司法解释引发宪法司法化问题的讨论还没完全结束，2003年5月，湖北青年孙志刚在广州被故意伤害致死一案再次引发违宪审查争议。宪法司法化起源于美国，现在已成为世界各国的普遍做法。宪法司法化的产生并非偶然，它有着重要的现实意义，尤其对于正处于建设社会主义法治国家的我国来说。长期以来，在我国形成了宪法不能作为直接裁判依据的惯例，使宪法神秘化、更闲置化，宪法的频繁变更削弱了宪法的稳定性和权威性。在公民因寻求最后一道宪法权利救济屏障而不断以宪法权利受
2、侵犯为由向法院起诉的同时，在世界各国是宪法司法化的普遍潮流影响下，在中国法治环境呈良性向前发展的情况下，我们不得不寻求新的措施去救济公民本应享有的宪法权利。如何解决这些问题是我国实现真正的社会主义宪政，应对本国乃至世界法治环境的挑战，正是我国宪法司法化所面临的严峻挑战。关键词：宪法司法化权利违宪审查宪政Paperabstract:In2001,theSupremePeople'sCourttakereceiveseducational-rightonQiYuLingtoviolateasbybutsuesmakesthejud
