1、quyuan完善我国夫妻财产制度初探--------------------------------------------------------------------------------完善我国夫妻财产制度初探作者：quyuan摘要夫妻财产制度是规定夫妻财产关系的法律制度。夫妻财产制的主要类型包括：古代的妆奁制，早期资本主义的“统一财产制”，近代的共同财产制，分别财产制，联合财产制。我国夫妻财产制立法经历了较长时期，2001年新《婚姻法》颁布实施。新《婚姻法》较1980年旧《婚姻法》有很大进步性：明确了共同财产范围，构建了夫妻专有财产制度，健全了

2、夫妻约定财产制度。同时新《婚姻法》具有显著的合理性，表现在其完成了以下三个过程的转变：从家庭本位到个人本位，从法定财产制到约定财产制，从静态财产制到动态财产制。新《婚姻法》在某些方面仍存在部分缺陷，主要表现在共同财产规定得很不周延；夫妻财产制度的约定缺乏公示程序的规定；夫妻财产制度缺乏协议变更程序；未规定别居制度等方面。笔者针对上述缺陷，提出了相关的完善建议。关键词：夫妻财产制度夫妻共同财产制夫妻专有财产制夫妻约定财产制AbstractCouplepropertysystemismadetoregulatecouplelegalsystemofproper
