1、论文题目：论地方性法规的司法适用专业：法律硕士（法学）硕士生：丁高指导教师：曹智摘要地方性法规的生命力在于实施，司法适用乃实施当中的重要环节，亦是衡量地方性法规文本质量优劣与否的检验标准。当今，地方性法规的司法适用率普遍不高是地方立法面临的顽症。以中国裁判文书网2013年至2017年6月援用了广州市地方性法规的判决书为实例对象的考察结果印证了地方性法规司法适用率低的痼疾，同时表明，司法中适用的地方性法规的规定不一致、法院内部沟通机制不顺畅、结案率评价指标对适用地方性法规有负影响、法官适用地方性法规面临责任与压力等司法环境、地方性法规的功能缺陷及传播
2、受限成为影响司法适用率的主要阻碍，故而，尚须增强司法人员适用地方性法规的意识，降低甚至豁免法官引用地方性法规面临的责任和压力，畅通法院内部沟通，强化地方立法宣传工作，以期化解法院在适用地方性法规时所处的困境，另一方面，要以合理性和操作性为着力点，以期提高地方性法规的司法适用的“实用性”，由此提高地方性法规的司法适用程度。关键词：地方性法规；判决书；司法适用；立法功能ITitle:OntheJudicialApplicationofLocalRegulationsMajor:JurisＭasterName:DingGaoSupervisor:CaoZ

5、hejudiciaryInconsistentregulations,unsatisfactoryinternalcommunicationmechanismsinthecourt,negativeimpactontheapplicationoflocalregulationsintheevaluationrateofclosingcases,responsibilitiesandpressuresfacedbyjudgesintheapplicationoflocalregulations,functionaldeficienciesinloca
6、lregulations,andrestrictionsonthespreadThemainimpedimentstoratesare,therefore,thereisstillaneedtoincreasetheawarenessofjudicialpersonnelinapplyinglocalregulations,toreduceorevenexempttheresponsibilitiesandpressuresfacedbyjudgeswhencitinglocalregulations,tosmooththeinternalcomm
