2、的系统性法律文件出台，农村集体土地征收逐渐暴露出诸多问题。除了公共利益界定问题、征收补偿安置问题之外，征收程序内部化问题成为整个征收程序难以实现维护被征收人合法利益的症结所在。要改变当前征收程序，必须对当前的集体土地征收程序进行重构，在清晰界定农村集体土地的权利边界的基础上，去除征收程序的行政主导性，扩大被征地农民的参与权，引入司法救济切实保障被征地农民的救济权利。以具体建设项目的申请启动征收程序符合正当程序的要求，为重构后的征收程序中诸多问题的解决提供了良好的程序开端。将集体土地征收程序划分为若干阶段并分阶段约束行权可以较为合理地解决当前程
