2、继承权的规则与如今的社会发展现状出现了分离的情况。一方面丧偶儿媳、女婿取得继承人的资格非常困难，另一方面也与其他继承人的继承权发生了诸多冲突，这与该规定的立法本意是相违背的。通过对几则案例的分析反思，可以发现我国现行丧偶儿媳、女婿继承权制度还存在很多不足之处，需要对该制度的重构提出设想。建议增加“无代位继承人”为前提，当存在代位继承人时则赋予其请求分得一定份额遗产的权利，同时适当放宽对“丧偶”这一前提条件的限制，对“主要赡养义务”的衡量标准进行明确。在对姻亲继承的合理性再分析后，希望能进一步建立与完善我国的遗产酌给请求权制度，保证继承法体系的完整与统一，真正发挥继承法对保证继承结
