13、ThisMutualNon-DisclosureAgreement(the“Agreement”)ismadeandenteredintoasofXXXX,2007(the“EffectiveDate”)byandbetweenXXXXXXXX.,aUSAlimitedliabilitycompany,a

18、is,hardwareconfigurationinformation,inventions,marketinformation,marketingplans,processes,products,productplans,research,services,specifications,software,sourcecodeortradesecrets,andothertechnicalandmarketrelatedinformation).ConfidentialInformationma
19、yalsoincludeinformationdisclosedtoadisclosingPartybyathirdparty.ConfidentialInformationshallnot,however,includeanyinformationwhich(i)waspubliclyknownandmadegenerallyavailableinthepublicdomainpriortothetimeofdisclosurebythedisclosingParty;(ii)becomesp
