1、ARTICLEⅨWARRANTYOFQUALITY1.GUARANTEEOFMATERIALANDWORKMANSHIPTheSellerforaperiodoftwelve(12)monthsfollowingdeliverytotheBuyeroftheVessel,guaranteestheVessel,herhullandmachineryandallpartsandequipmenthereofthataremanufacturedorfurnishedorsuppliedbytheSe
2、llerand/oritssub-contractorsunderthisContractincludingmaterial,equipment(howeverexcludinganypartsfortheVesselwhichhavebeensuppliedbyoronbehalfoftheBuyer)againstalldefectswhichareduetodefectivematerials,and/orpoorworkmanship.2.NOTICEOFDEFECTSTheBuyersh
3、allnotifytheSellerinwriting,orbytelexconfirmedinwriting,aspromptlyaspossible,afterdiscoveryofanydefectordeviationsforwhichaclaimismadeunderthisguarantee.TheBuyer'swrittennoticeshalldescribethenatureofthedefectandtheextentofthedamagecausedthereby.TheSe
4、llershallhavenoobligationunderthisguaranteeforanydefectsdiscoveredpriortotheexpirydateoftheguarantee,unlessnoticeofsuchdefects,isreceivedbytheSellernotlaterthanthirty(30)daysaftersuchexpirydate.Telexedadvicewithbriefdetailsexplainingthenatureofsuchdef
5、ectandextentofdamagewithinthirty(30)daysaftersuchexpirydateandthataclaimisforthcomingwillbesufficientcompliancewithrequirementsastotime.3.REMEDEYOFDEFECTSTheSellershallremedyatitsexpenseanydefects,againstwhichtheVesseloranypartoftheequipmentthereofisg
6、uaranteedunderthisArticlebymakingallnecessaryrepairsand/orreplacement.Suchrepairsand/orreplacementwillbemadebytheSeller.However,ifitisimpracticaltomaketherepairbytheSeller,andifforwardingbytheSellerofreplacementparts,andmaterialscannotbeaccomplishedwi
7、thoutimpairingordelayingtheoperationorworkingoftheVessel,then,inanysuchevent,theBuyershall,causethenecessaryrepairsorreplacementstobemadeelsewhereatthediscretionoftheBuyerprovidedthattheBuyershallfirstandinallevents,will,assoonaspossible,givetheSeller
8、noticeinwriting,orbytelexconfirmedinwritingofthetimeandplacesuchrepairswillbemadeand,iftheVesselisnottherebydelayed,orheroperationorworkingisnottherebydelayed,orheroperationorworkingisnottherebyimpaired,theSellershallhavetherighttoverifybyitso
