1、安徽大学硕士学位论文论民国时期物权法的近代化姓名：左学和申请学位级别：硕士专业：法律史学指导教师：韩秀桃2003.4.28论文摘要物权法作为调整主体对客体的财产支配关系的法律，是人们从事社会经济活动最基本的法律规则之一。在“德礼为政教之本，刑罚为政教之用”思想指导下，中国古代的法典结构皆是以刑律为主、民刑不分，物权法规范淹没在刑事法律之中。虽然物权法没有形成独立的系统，但其自身也经历了一个漫长的发展历程，例如典权。鸦片战争之后，在西方法文化的冲击下，中国物权法开始了近代化的进程。清末的改法修律，由于内忧外患的压

2、迫，在立法上基本采取移植西方法律的方法，以致远离了社会生活。民国时期对中国固有物权法和西方物权法采取兼容并蓄的态度，以司法实证作为整合固有物权法和继受物权法的标准。民国北京政府时期的最高审判机关——j赶理院通过民事判例、解释例来创制适合时代需要的物权法律规范，以渐进的方式推进固有物权法与继受物权法的融合。这样，以固有物权法与继受物权法为基本材料，初步建构完成了稳定性与灵活性兼备的近代物权法。[Abstract]：Propertylaw(iusrerum)isthelegalsystemrelatingtothe
