2、损害赔偿。赔偿的范围主要为固有利益之损害。例外情况下也包括履行利益。违反保护义务破坏了当事人之间信赖基础时，也可构成合同解除之原因。多数情况下，违反保护义务也可以成立侵权责任，与合同责任形成所谓的责任竞合。实际上，我国《合同法》关于合同责任与侵权责任竞合的规定，主要就是在违反保护义务的情况下具有意义。第六章，保护义务的具体适用。结合我国合同法和判例的具体情况，深入探讨安全义务与解释义务的背景、内容、界线、标准、类型等与保护义务的具体适用有关的重要理论问题，并着重分析了我国判例中的保护义务，以图建立保护义务具体适用的理论基础。关键词：保护义务；固有利益；履行利益
