2、C),isastatefundedprogramtoprovidelongtermcareservicestoassisteligibleconsumerstoavoidordelayinappropriateinstitutionalization.Provisionoftheseservicesisbasedontheavailabilityoffunds.Statefundsfurnishedthrough22MRSA§§7301-7306and§§7321-7323maynotbeusedtosupplanttheresource
3、savailablefromfamilies,neighbors,agenciesand/ortheconsumerorfromotherFederal,Stateprogramsunlessspecificallyprovidedforelsewhereinthissection.StateHBCfundsshallbeusedtopurchaseonlythosecoveredservicesthatareessentialtoassisttheconsumertoavoidordelayinappropriateinstitutio
4、nalizationandwhichwillfosterindependence,consistentwiththeconsumer'scircumstancesandtheauthorizedplanofcare.(B)Activitiesofdailyliving(ADLs).ForpurposesofeligibilityADLsshallonlyincludethefollowingasdefinedinSection63.02(B):bedmobility,transfer,locomotion,eating,toileting
5、,bathinganddressing.(C)Acute/Emergency.Acute/Emergencymeansanunscheduledoccurrenceofanacuteepisodethatrequiresachangeinthephysicianorderedtreatmentplanoranunscheduledoccurrencewheretheavailabilityoftheconsumer’sinformalsupportorcaregiveriscompromised.(D)AssessingServicesA
6、gency(ASA)AssessingServicesAgencymeansanorganizationauthorizedthroughawrittencontractwithOfficeofElderServicestoconductface-to-faceassessments,usingtheDepartment’sMedicalEligibilityDetermination(MED)form,andthetimeframesanddefinitionscontainedtherein,todeterminemedicaleli
7、gibilityforMaineCareandstate-fundedcoveredservices.Baseduponarecipient’sassessmentoutcomescoresrecordedintheMEDform,theAssessingServicesAgencyisresponsibleforauthorizingaplanofcare,whichshallspecifyallservicestobeprovidedunderthisSection,includingthenumberofhoursforservic
