1、中文摘要网络的日益发展影响着整个社会，亦包括对法律的影响。网络舆论是网络的附属物之一，是民主社会必不可少的产物。网络舆论对司法量刑产生了正反两方面影响。一方面，网络舆论可以监督司法、宣传法治；另一方面，网络舆论对量刑活动带来压力和负面影响也日益凸显。如何因势利导让网络舆论为司法服务，同时避免出现舆论审判，使网络舆论与司法活动实现良好的互动，促进二者共同和谐发展，这一现实问题应引起网络媒体、司法部门的足够重视。本文由李昌奎案引出网络舆论影响量刑的问题，综合阐述了网络舆论对司法量刑的积极影响和消极影响，再进一步对网络舆论影响量刑的原因进行了理性分析，最后提出了如何充分发挥网络舆
