1、我国城市土地权利配置制度研究内容摘要我国进入土地有偿有期限制度的时代以来，城市发展突飞猛进。但是城市土地权利配置制度依然有着诸多问题，这些问题是城市化进程的阻力，不利于资源的合理配置。通过对我国城市土地权利配置制度渊源的梳理，系统的总结出当前我国城市土地权利配置制度的特点以及出现的问题。对城市土地所有权利的整理，出让土地使用权期限问题，存量划拨土地使用权的处理和划拨方式滥用分析了这些现实问题的原由，分别提出了对策。城市土地所有权利类型问题表现为城郊地区的集体土地征收问题和“城中村”问题。对于此现象要事先规划

2、，整合土地资源和劳动力资源，改善补偿方式，主张土地国有化理论从根本上解决问题。出让土地使用权期限是非常普遍的现实问题，提出借鉴台湾地上权的相关制度，并且完善续期时间、次数等具体问题的规范，住宅用地支付土地出让金部分应根据住宅面积、住宅类型区分性的收费。对于存量划拨使用权问题和划拨方式滥用的问题，综合与划拨土地使用权制度予以探讨。以法律经济学相关理论分析了划拨土地使用权配置的基础动力，提出对公益事业用地进一步分类处理。进一步利用好城市土地储备制度治理存量划拨土地使用权问题。关键词：城市土地权利制度、权利配置、
