1、中文摘要社会弱势群体是每个时代每个社会都客观存在的问题。弱势群体权利保护问题解决的如何关系到一国社会和谐稳定的发展。当下的中国正处于转型时期，弱势群体权利保护成为一个突出的问题。在弱势群体权利保护的基本理论上，罗尔斯与德沃金两位学者处于领先地位。罗尔颠的正义论与德沃金的权利论都蕴含着对弱势群体权利的保护理论依据。立足于中国弱势群体权利保护的现状，借鉴两位学者的相关理论探讨中国弱势群体的法律保护基本问题。对于我国弱势群体人权保障制度具有重要的理论价值与现实意义。关键词：弱势群体保护；罗尔斯的差别原则；德沃金的权利论；实质平等黑龙江大学硕士学位
