2、越了原有法律管辖区域的划分，容易形成跨国界、跨地域性的情况。特别是在犯罪地点的确定、犯罪行为合法性的判断等方面更是颠覆了传统的管辖规则，使网络犯罪刑事管辖陷入困境。面对网络犯罪的特殊性，笔者认为应当站在法价值论的高度，追寻网络犯罪刑事管辖的“效率”价值目标。同时应当尊重技术自身的发展规律，倡导运用技术自身的力量解决技术所带来的法律难题。所以在确定网络犯罪管辖权的归属时，应当全面考察网络特有的属性和特征，梳理管辖权的确定依据，以此寻找出适合网络犯罪案件特点的、具有可操作性的刑事管辖原则。本文主要从对网络犯罪概念及特征的研

3、究入手，深入阐释了网络犯罪的基本内涵，并对各国关于网络犯罪刑事管辖的立法现状和国内外学者的研究成果作了一全面搜集和分析，然后结合网络空间犯罪行为自身固有的技术要素，立足当前我国司法实践，提出应建立一套以传统的属地管辖原则为基础，以侵害或影响关联性原则和便利原则为补充的网络犯罪刑事管辖规则，以期对发生在网络空间中的犯罪行为的刑事司法管辖权的确定产生积极的意义。关键词：网络犯罪刑事管辖建构中图分类号：D915．1AbstractInrecentyears，networkhaspenetratedintothehuman's
