2、roflawUniversityXiangtanUniversityDateJune2018摘要审判阶段补充侦查是指检察人员在案件的审理过程中，发现提起公诉的案件需要补充侦查，并提出补充侦查建议的，人民法院可以延期审理，补充侦查的期限是一个月，且补充侦查以两次为限。而审判阶段的补充侦查有启动主体单向性、侦查主体复合性、启动事由宽泛性、侦查次数有限性以及侦查效果待定性等特征。这一机制在刑事诉讼程序中具有事实查明、证据审查、程序倒流和督促侦查等功能。现阶段，虽然法律对于审判阶段补充侦查的时间、次数有了限制，但是对启动事由规定太过宽泛，导致实践中，补充侦查率过高

3、，而且二次退查居高不下；同时由于缺乏必要的引导和监督机制，导致实践中承担具体补充侦查职责的侦查机关往往无法满足补充侦查的预设要求，使得补充侦查的效果虚化。此外，由于检察机关拥有补充侦查的决定权，导致了实践中控辩不平等，控审不分离，使得法院无法确立在补充侦查侦查适用决定环节的审判权威，被告人亦在审判阶段补充侦查过程中无任何参与权与抗辩权，致使补充侦查成为了人民检察院用来规避无罪判决，化解败诉风险的工具。目前，在以审判为中心的诉讼制度改革下，要加快对审判阶段补充侦查的改革与完善，在理论重构，实现控辩审三方在补充侦查中的共同参与的基础上，通过对启动主体、事由、过
