1、ANTENNATOWERSPACELEASEThisLeaseismadeandenteredintobetweenCityofBillings,Montanahereinafterreferredtoas“Lessor,’andKTVQCommunications,Inc.,hereinafterreferredtoasTennant”.RECITALSLessorownsatowerandequipmentbuildinglocatedinBlackOtterTrailinBillings,MontanaatNorthLatitude454452,”
2、WestLongitude1082423,”towerregistrationnumberN/Ahereinafterreferredtoas“Tower.”TennantisatelevisionstationservingtheBillingscommunityandsurroundingarea.Towardthatend,Tennantneedstolocateacameraandtelecommunicationsequipmentonthetowerandinthebuildinglocatedatthebaseofthetower(here
3、inafterreferredtoasthe“leasedpremises”).Specifically,itneeds:1.tohaveaccesstothetowerandthebuilding;2.toinstallacameraandradioequipmentandantennasonthetower(towerequipment),and3.tohouseradiosandaffiliatedequipmentinsidethebuilding(buildingequipment),and4.toinstallwiringtointercon
4、nectitstowerandbuildingequipment.TERMSOFLEASESubjecttothetermsofthisagreementLessoriswillingtoallowTennanttohavesuchrightsandaccessnecessarytomeetitsneedsasdetailedabove.Itisthereforeagreedasfollows:DurationofLeaseThisLeaseshallstartonDecember15,2009,andshallcontinueforfiveyearse
5、xpiringonDecember15,2014.Rights,ObligationsandDutiesofLessorandTennant1.Tennantshallbeallowedtoplacesaidequipmentforanannualfeeof$3,500peryear,tobetradedforadvertisingorvideoproductionservicesforthebenefitoftheCityofBillings'projectsand/orservices.Nosuchadvertisingshallbeclassifi
6、edas“IssueorPolitical”advertising.Issue6advertisingisadvertisingplacedbyathirdparty,committeeororganizationonbehalfofacandidateorballotissue.2.Renewal.TenantshallhavetherighttoextendthisLeaseforanadditionalfive-yearperiod,withCityCouncilapproval,foranincreaseof12.5%intheannualfee
7、forthisadditionalfiveyearperiodasitissetforthabovein.3.SubjecttothetermsofthisLeaseTennantmaylocateone(1)motorizedcameraanda3-footmicrowaveantennaandaffiliatedequipmentontheleasedpremisesforpurposesofreceivingandtransmittingvideoanddatatraffic.4.Tennantmaynotsublet,license,affili
