2、体系，因此，必须重视生存权保障制度的构建和完善。面对当前人权理论和实践中对于生存权的片面以及错误的认识，我们需要明确生存权的含义，分析公民生存权保障中出现的问题并加快建立和完善生存权的权利保障机制。本文通过分析“国内追讨生存权第一案”,总结了其争议的主要问题。揭示出该案例中出现的争议问题正是由于我国生存权保护制度的不完善和相关保障机制的缺失导致。接着笔者阐明了“生存权”的含义，界定了生存权与生命权、相当生活水准权等其他相关概念的界限，解决了理论界关于生存权概念混乱的问题。并从生存权的宪法保障层面分析了生存权宪法保障的意义，并提出国内公民生存权宪法保障中存在的
