1、的自身制度安排和法理学基础。但是仅有信托制度的自身设计并不能完成风险隔离的全部，因此，下文将在本章理论的基础上引入信托风险隔离的保障性机制。本文第三章是重点章节，主要介绍商事信托风险隔离功能的保障性机制。信托风险隔离的实现一方面要依靠信托法律关系中的衡平机制，即受托人信义义务设置和受托人与委托人、受益人权利衡平机制；另一方面，信托外在的制度安排——信托登记制度和对整个信托业的监管机制也是保障商事信托风险隔离功能实现的外部性制度。本章以受托人的权利衡平和受益人的权利保障为法律精神引导，重点阐述与之相适应的制度安排，从而达到规避、防范信托风险
