5、IFORMDOMAIN-NAMEDISPUTE-RESOLUTIONPOLICYDavidA.Simon*Abstract:Sinceitsinceptionin1999,theWorldIntellectualPropertyOr-ganization(WIPO)hasresolvednearly22,000domain-namedisputesun-dertheUniformDomain-NameDispute-ResolutionPolicy(UDRP)—amandatoryarbitrationpolicyimplementedbytheInter
6、netCorporationforAssignedNamesandNumbers(ICANN).TheUDRPallowstheholderofalegallyprotectabletrademarktoinitiateproceedingstocancelasimilardomainnameorhaveittransferredtothetrademarkowner.Domain-nameholders,though,haveanumberofdefenses,includingthattheyareusingtheirdomainnamesinanon
7、commercial,fairmanner.AlthoughseveralempiricalstudieshaveanalyzedvariousaspectsoftheUDRP,nonehavespecificallyexaminedthisfairusedefense.Thisstudydoeswhatothershavenot.ItanalyzesthefairusedefenseindecisionsbeforeWIPO.UsingWIPO’sonlinedecisiondatabase,thisstudymakestwoimportantfindi
8、ngs.First,respondentsfromtheUnitedStatesaremorelikelythanthosefromothercountriestosucceedonafairusedefense.Second,arbitratorsfromtheUnitedStatesaremorelikelythanthosefromothercountriestofindthatarespondent’suseofadomainnamewasfair.Thismeansthat,undertheUDRP,respondentsfromtheUnite
