1、摘要人身权利是人作为个体存在与发展的基础，是人权范畴中最基础的内容。现代各国，在法律上对人身权利都充分给予肯定，我国也逐渐形成了由宪法、刑法、民法、行政法、劳动法等不同的法律部门对其进行共同保障和规范的法律制度。其中，因人身权利受损而引起的人身损害赔偿制度则是对人身权利进行保障的关键。但是，在司法实践中，根据法定主义、依据现行法律制度中对赔偿权利人的身份、居住地的差异，在赔偿范围、赔偿标准等方面进行差别适用以计算出受害方应该获得的人身损害赔偿金数额，结果在同一、同类案件裁判后进行对比则有各受害人“赔偿数额”之间差距巨大、“同命不同价”、“同损害

2、不同赔偿”的出现。这与尊重生命、尊重人权，“法律面前人人平等”的原则完全相悖。对此，我们应该完善我国的人身损害赔偿法律制度，消除制度中不合理的差异性规定。进一步完善我国现行人身损害赔偿制度，应着重注意如下方面：(1)梳理清多元的赔偿制度，优先适用侵权责任法；(2)统一赔偿标准，实现城乡无差别对待；(3)确立刑事附带民事赔偿诉讼中的精神损害赔偿制度；(4)建立人身损害救助基金制度。关键词：人身权利；损害；赔偿制度AbstractPersonalrightsasthebasisofindividualexistenceanddevelopmenta
