1、建国以来我国农地所有权制度变迁的特点及绩效分析程度和主体的不同将建国来我国农地所有权制度变迁过程分为三个阶段，即完全的农民土地所有权阶段、集体土地所有权阶段和所有权各权能分割的家庭联产承包责任制阶段。此前，丁关良在2002年8月版的《农村土地承包经营权初论一一中国农村土地承包经营立法研究》作过类似的划分，他根据占有权和使用权不同将该时期分为六个阶段。第二，研究角度的创新，以往我国学者在对该时期进行研究时都是从物权法等立法的角度来分析的，本文则从制度变迁的角度进行分析。第三，在具体的分析方法上采用了委托代理理论，通过模型来说明不同阶段制度变迁的得失及其原因。4关键词：土地所有权产权制度变迁AB
