1、3.OBLIGATIONSOFTHECONTRACTOR3.承包商义务3.1.TheContractorshalldispatchsuchnumberofitsservicepersonneltofullyandefficientlyaccomplishtheservices.3.1承包商应派一定人数的服务人员充分有效地完成服务。3.2.TheContractorshallbesolelyresponsiblefortheselectionandhiringsupervisionofitsapplicants
2、,includingthoseassignedtoperformtheservicesunderthisAgreement.Thisnotwithstanding,andsubjecttotheprovisionofparag.5.1,theClientmayrequiretheContractortoreplacemanpoweritdispatchediffoundtohavecommittedanactoractsdetrimentaltothewellbeing,interest,safetyands
3、ecurityofClientanditsemployees.Insuchcase,theContractorshalldispatchanotherservicepersonnelfullyarmedwithwrittenappointmentissuedbytheContractornotlaterthanoneweekafteritsreceiptoftheClient’srequest.3.2承包商只负责从申请者(包括根据本协议被分派去服务的人)中选择和雇用监督。尽管如此，且受制于第5.1段的条款，当
4、发现做出有损于客户及其雇员的利益、安全时，客户可要求承包商换人。这时，承包商应在接到客户要求后的一周之内另外派遣持有委任书的服务人员。3.3.TheContractorshallensurethatallmanpowertobedispatchedhavebeenproperlyselected/screenedandtrainedtoperformtheirtask.Contractorshallhaveevaluated,toitssatisfaction,thepsychological,IQandme
5、dical(whichshallincludetheresultsofadrugtest,bloodtest,urinalysis,fecalysis,x-ray)andNBI/Policerecordsofsaidpersonnel.3.3承包商应确保派遣的所有人员都是经过适当挑选/筛选和培训的，足以完成其任务。承包商应对心理、智商和体检(应包括药检、验血、大小便化验、X光拍片的结果)以及NBI/警方对该人的记录进行评估，以满足要求。3.4.TheContractorshall,uponexecutiono
6、fthisAgreement,furnishClientwithalistofpersonnelwhowillbedispatchedtoClienttoperformtheServicesstipulatedunderthisAgreement.AnypersonneloftheContractorwhoisnotpreviouslyreportedinthelistoranyamendmentstheretomaybedeniedentryintheConstructionPremisesof/bythe
7、Client.Accordingly,itisincumbentuponContractortopromptlynotifyClientinwritingofanychangestothelistofitspersonneldispatchedunderthisAgreement;3.4承包商在执行该协议后应立即向客户提供一份根据本协议派遣到客户那里提供服务的人员名单。客户将拒绝一切名单或其修订文件之外的人进入施工场地。因此，当派遣人员名单有变动时，承包商有义务立即以书面形式通知客户；3.5.TheContr
