1、中文摘要保险代位求偿原则作为保险法律体系的重要原则之一，己经得到了世界各国保险立法的普遍承认。随着保险业的蓬勃发展,保险人代位求偿案件也越来越多,但由于我国保险立法尚不够完善，因此在保险人行使其代位求偿权时出现了许多问题，本文以司法实践中的具体问题为着眼点分析了保险人在具体行使代位求偿权过程屮的若干问题。木篇论文整体结构分为绪论、正文和小结三个大部分，其中本篇论文重点讨论的正文乂分为三部分:第一部分，文章援引了与保险人行使代位求偿权相关的案例，捉出了代位权行使过程屮的问题；第二部分保险人代位求偿权概述，主要讨论了保险人代位求偿权的概念定义、代位求偿制度所体现的主要功
