1、FIDIC合同条件下承包商索赔价款研究摘要欧美等市场经济发达国家对索赔的研究己有五十多年的历史，积累了比较丰富的经验，形成了一定的理论体系和比较完善的程序方法。它有效地使合同双方风险分担趋向合理，对提高企业和工程项目管理水平起着重要的促进作用。随着我国改革开放，特别是加入WTO以后，大量外资项目和世界银行等贷款项目的建设、对外工程承包业务的发展以及经济建设法律、法规的不断完善，工程索赔逐渐被国内的业主、工程师和承包商所认识和重视。但总体而言，工程索赔及其管理还是我国工程建设管理中一个相对薄弱坏节，索赔意
2、识薄弱，对索赔及索赔管理的重要性没有足够的认识和重视。本文首先对新版FIDIC施工合同条件进行详细解读和分析，紧接着又分析了FIDIC施工合同条件下，承包商索赔的原则及处理程序，为承包商进行索赔管理做好了理论准备。其次，结合FIDIC合同文本、施工索赔有关条款、从承包商的角度出发，主要对合同的原始状态、合同的假想状态和合同的现实状态进行了分析，结合合同状态分析对索赔机会的识别、索赔事件的构成进行系统的论述。最后在此基础上分析了索赔价款的计算方法。关键字：FIDIC合同条件承包商索赔Researchonc
